It doesn't matter if he risked injury to himself, its not posted that he isn't allowed to do that even, if the rules aren't clearly posted then if a person brakes one they can claim stupidity against the rule and these days with how many dumb lawsuits are going through, will win. Its the classic style of the criminal braking in and getting hurt so suing the place he broke into.
Stupidity is no excuse for flaunting policy. In fact, it only strengthens the store's case in court. Judges don't tolerate idiocy and the lack of common sense. Every escalator has a sign posted to step on to the ride carefully--and those with wide open spaces between the escalators often have signs as well telling patrons to just steer clear. If they don't, they usually have metal discs about 2 inches high mounted along the run of empty space to prevent jackassery such as this.
Even with signs which I don't see any here, the moment the guard touched him the situation changed from a 'please don't do that again, you could get hurt or hurt someone else' to assault of a minor. If the LP officer would have helped him up and had him walk with him, then everything would have been fine, but No LP officer has the right to drag a child across the floor for Any reason. To a very large degree your right, but at the same time if the kid would have stood up and pushed the guard, the rent a cop as you call him would have been in full right to detain him for striking an officer and holding him until the police arrive. There is a Big differance between being arrested for something thats against the law, and getting your rights infringed on. There is no 'right to slide down an escalator'.
