  • I disagree with this vid. You say none of this is new, but that the companies were *actively promoting* piracy was news to me. I consider the video valuable (though I'll concede it might not be the /first/ one to point someone to who hasn't heard of SOPA before), and it certainly raises a challenge to the notion that "everyone agrees piracy is a problem, but..." arguments I've been hearing. No, hypocrite companies pushing for bullshit legislation is the problem, not piracy.

  • @desertasophy Michelle would have to disable comments on just about everyone of her videos then. Just randomly clicking on one of her videos and scrolling the comments, there's always someone who is more than happy to bring up animal testing, Lancôme, and her involvement with the company.

    Seperate but related, her Lady Gaga and Disney makeup tutorials might come into question under SOPA.

    Not sure why the ATR was involved. Only that Grover Norquist once strongly supported SOPA and Lamar Smith boasted about it. Norquist has since backpedaled.

    I come up with nothing about L'oreál. Their involvement could put Michelle Phan in kind of a bind. Both L'oreál and Lancôme are named as supporters.

    I agree there is a BETTER way and perhaps it should be found, but what my point is - we shouldn't say "stop SOPA" - before we have a good alternative to the problem.

    Law works in a way where some of our rights are constricted by it (to go to the extreme - it's like saying I cannot kill a person - where is my freedom!)

Besides when freedoms are removed through laws, rarely are they reversed. I don't see the patriot act being recalled any time soon, piracy will be around for a long time, so will SOPA, eventually it will be exploited, it may not be this government, or the next, but it will happen.

  • @TheViolander Furthermore, why should the honest customer always be the one who gets more hassle than pirates? Look at download platform Steam from Valve, they provide PC Gamers with better service than any pirate with a torrent.

    Once purchased, games can be downloaded as many times and on as many PC's as you want, game downloads are fast & patches are downloaded automatically, great sales, chatting while gaming and sometimes also Steam Cloud (back-up save files on the web).

  • @Black8035 The drawbacks your described are a necessary evil. Right now piracy is a norm for most of us (hell one guy a comment below just said we should ignore it and that it will always be, which proves this point). That should not be the case, that should simply be battled. In a war (in this case on piracy) to make something right people suffer, sometimes innocent, it's often the result that matters, is it not?

  • @TheViolander What I wanted to say with my second comment was that the only fair way to combat piracy is to provide customers with a better service than some pirate could ever do. Even then you will still have some piracy, because if you have honest customers, you will also have people who will pirate. They're two opposite sides of the same coin, they cannot exist without each other. It's the same with war and peace etc.

    However, you can always try to minimize something.

  • @Black8035 Unfortunately honest customers are rare. People are greedy bastards and will often choose to take something free rather than pay for it.

    If giving a good service somehow battled piracy we would have seen significant result by now, but piracy has been increasing at a huge rate for the past 5 years.

    Also just because two sides of the coin exist - it does not mean we should not do our best to eradicate the worse one, and in a way, a flawed one it may be - sopa is that way.

In your little so called solution you had no mention of torrents, which already operate under the radar (also the system in place NOW, is almost exactly like the one you described and it hasn't been working for a while.

In fact the good here is potentially destroying or at least fatally harming piracy, as opposed to a little harm on the freedom of speech which as I have stated before - every law somehow restricts your freedom (eg there is a law in place that you cannot publish anything that seeks support or encourages racist movement - some might argue that attacks freedom of speech.

But this is a policy that CAN and most likely WILL harm piracy in a major way, and no this is not done for YOUR benefit (nor mine) but that is how laws work, they seldom work to improve one individual's life - rather they improve society as a whole.

    and that is a big enough tick in the pros column to balance our some cons IN my opinion.

MOST games right now are made on consoles only because the companies realise what loss they are making by putting it on the PC and exposing it to the huge thievery channel that is piracy.     ultimately when you elect a government you should leave it up to them to weigh the pros and cons of such dilemmas.

    I am merely giving my opinion on that SOPA is not as bad or wrong as people make it out to be. (and most, not all, but most people are doing it because they fear they might not be able to download a free movie anymore)

  • @7777TheShade that's what should happen, if someone is using a copyrighted song the site SHOULD get taken down, after all the administrator should either be responsible for thsoe who post on his/her site or simply not allow it.     I was comparing this to the situation where one of the mall's stores is used to sell drugs - therefore the mall owners should be responsible and prosecuted. What you described is a crime happening within a certain space....

You REALLY think the YouTube guys will spend all of their time trying to watch over a million possibly a BILLION videos trying to see if there's piracy? I can understand if some pirate website steals a game recently released, I can understand if YouTube just let a guy make money off of his stolen video. But really, SOPA and ACTA are going too far with their act.

No I do not think they will spend all of their time doing that, but I do (and i say this honestly) think they should, people running the website should be responsible for what they allow to run on their website, I made the comparison to the mall for a valid reason, I was comparing how it is in the real world and how it should be in the electronic one. The thefts or crimes in both are very much identical, why should the laws not be?

  • @TheViolander The scenarios are actually VERY different. Opening a store in a mall is presumably a (relatively) large financial investment, and will in most cases involves lots of legal agreements. Opening an account and uploading something to e.g. Youtube is done in a few clicks, totally free and with no monetary investment.

    On a side note digital crime is not like real-world crime, since the actual copy that is stolen didn't cost anything to produce.

  • @TheRealDezuman to your first post I say this - you are saying how things are and because of that they cases are different, that is silly since just because atm it is EASIER to commit alleged crime - does not mean the laws shouldnt prosecute them or make it more difficult.

    And digital crime is a lot similar to real-world (the cost argument is invalid because even though there is no marginal cost to producing a digital version - there is still the overall cost of that project)

    Do you think a mall chain would fund the opening of stores in rivaling malls to discredit them, with the risk of it being traced to them because of the money and legalities involved? I don't think so.

    Do you think an influential corporation would with minimal investment and total anonymity get even the smallest competitor shut down, no strings attached? Of course they would!

    And as answer to your 2nd question - an influential corporation has no incentive to spend any amount of money to shut down a minor competitor. (such projects have negative Net present value)

As it usually is with new stuff, it spawns new actors and encourages innovation. However the Old Brontosaurus Corporations, in the purest old-European colonial spirit, ventures to stake out their claims with the catchphrase: "We pay the politicians donuts, die SUCKERS!"

  • @TheRealDezuman They are different in many aspects, but ultimately it comes down to copyright infringement and the potential of these acts to stop this crime.

    Digital and real-worlds copies are just different ways to carry out this particular crime.

    And to compare how they are fundamentally different is taking this argument completely off tracks and does not relate to my initial point at all.

  • @Patrick128000 Well Assassin's Creed Brotherhood and Revelations only had a one time activation. I have ACR on PC and it went fine.

    Anno 2070 had DRM that limited the number of times you could activate your copy (whenever you would switch your gpu - max of 3x), now they've removed it, although the restriction of motherboard changes are still there (max of 3x).

    For future games, I'd recommend to keep an eye on the DRM that's being used.

    and the upside of SOPA is a potential strike on piracy, you should know that.

    Also as i have stated many times SOPA is flawed, and needs to be addressed so that it cannot be exploited, but at this moment in time it is the closest we have come to potentially close down Internet piracy

  • TotalBiscuit, no offence, I think you're a great guy, but I think your SOPA video was just as biased as his. You kept saying why it was bad, and didn't provide any point for the other side.

    The lobbyists will only see themselves as trying to protect companies from piracy- I highly doubt they want to purposefully kill off the Internet.

    I personally don't support SOPA and PIPA, however, I think it is in the interests of fairness, balance, and good argumental technique to see both sides .
