If there are certain circumstances in which it's acceptable to torture/kidnap/assassinate people then why doesn't the United States relinquish its signing of the treaties that ban this practice? The US has signed the NPT (as has Iran) yet the US uses depleted uranium munitions in built-up areas (munitions BANNED by the NPT). The US uses collective punishment (BANNED by the Nuremberg Charter) yet blocks water supplies to Fallujah. What gives?

@talbotpearson - regardless of the torture issue, there is a due process issue: people need to be tried eventually, by a competent authority, to determine whether they should be incarcerated. To detain indefinitely without trying someone is not only mean, it's a waste of money. Why would a soldier in GITMO care about trying an possible insurgent? They'll just be redeployed if the base isn't needed. You have to have independent competent juries, who have an interest in getting it right.

The way they were treated at Gitmo...yeah they are given a Koran...soccer balls to play. I don't EVER remember seeing an American soldier playing football in any prison camp ever. When our guys get captured they get the shit the beat out of them....if they are lucky...but usually they are either starved...like Japan did to em...plus beat em..or just killed dismembered, and drug through the streets where civilians beat them more and then they are hung from bridges and burned.
