The courts decided that the order to exit was not reasonalbe because the agents never had probable cause to remove the individual from his automobile.
Of course the location is relevant as the courts have decided that different rules apply here than apply to border checkpoints.

We are going to be judged no matter what, a lot of people, when they think of judgment, think of it as a bad thing. However, even those who receive eternal life are JUDGED to eternal life. @pensacotti I disagree (but don't care enough to argue further). The officer stated he was under arrest because the dog indicated there was something unusual in his car AND he was not cooperating and resisted the request to exit the vehicle. I think probable cause can be argued. Does the constitution provide that we have the right to examine and question the dog, or ask to do the canine check over again because you don't like how it turned out? IMHO the situation was EASILY avoidable.
You are free to argue it, but it's an empty argument. The courts decided that probable cause was not obtained. The driver knew as well, since he was adamant that the dog didn't alert.
We do agree on one thing, the situation would have been easily avoidable...
if the dog handler hadn't lied about the alert. In that case, the agents most likely would have waved the driver on...

Police officers, if they have a k9 alert, CAN arrest you and they WILL use force. Dog alert constitutes probable cause. But then, fact is these cops DID intentionally cause the dog to alert (there were NO drugs) to justify the arrest. That's criminal act btw.

The officer stated he was under arrest because the dog indicated there was something unusual in his car AND he was not cooperating and resisted the request to exit the vehicle. I think probable cause can be argued. Does the constitution provide that we have the right to examine and question the dog, or ask to do the canine check over again because you don't like how it turned out? IMHO the situation was EASILY avoidable.

after seeing all the information (via) youtube anderson did nohing wrong at the illigal check point. telling someone there under arrest for failure to comply with a order naaa no justification for us of force. as a ex-cop myself i hope to god that anderson sued the hell out of all the officers there that night and got a new pair of boots made out of dog skin....

I'm completely stunned by this video and the comments in response to it. We really are conditioned and programmed to be slaves. I question authority because it is my duty as an American to do so. This man did nothing to deserve being tazed and beaten. If you believe he did you're good little citizen who follows orders and I am sad for you. God help us all.

whats everyone so pissed about...if the dog alerted to the car then they have probable cause to search it...if the dogs alert gave no authority to search then what would be the purpose of them...for all we know the pastor could have had weapons in the vehicle and didnt want the authorities to find them...just becuase hes a pastor doesnt mean they arent capable of any wrong doing...and he wasnt beaten...he was injured becuase he was ressisting...next time just do what they say and u will be letgo

umm becuase not all illegal immigrants and narcotics are arrested/seized on the border...there isnt enough man power to control every place on the border...the checkpoints are set up on main highways to apprehend/sieze contraband...most of the drugs siezed by the borderpatrol are at the checkpoints...and just becuase ur an american doesnt mean u arent capable of smuggling anything...some people are desperate and do anything to try and make some money
