  • I do this shit every time . BUT the trick is to try and not let him know you are taking a vid . This one time i got pulled over and had a lil weed in the car . Something told me to Pull out my vid cam on my phone . As i put it in the passenger seat and proped it up a lil . The conversation was all recorded . To make a long story short he wound up forcing me to get out of the car and did not ask me for consent just went to searching . well he found my weed , but when I showed that to my lawyer :)

  • @bockydo You must be in a "one party consent" state. If you video and audio tape a person without their consent in a two party state (most of them are), your recording would have been inadmissible in court.

    The best bet is to immediately let them know you are video and audio recording. Once you do that, you are legally protected since they have full knowledge that it is happening. And you can refuse the illegal order to shut it off.

  • There is no law saying that you can't video tape at anytime. You got searched out of the officers safety you kept moving around how was he supposed to know that you didn't have a weapon. He said he seen a beer open. There is the legal right to search right there. If they suspect your under the influence they can search then too. So even if you were not video taping you and your friends and your car could have been searched anyway. To know your rights read a book.

  • @Lboyer1992 there are presently 12 states in the USA where the audio and videoing of police officers is illegal....I know my state, massachusetts is one of them. Massachusetts has started to use old "anti-wire tap laws" and interpreted them the same as video/audio recordings. The convictions "have helld up in the Mass. courts. Go on the net and google "are cameras the new guns" It is a frightening eye opener.

  • @inkey2 Actually, there are only two states that you can't tape because the laws don't give a "reasonable expectation of privacy" exemption. Almost every single case brought up regarding the wiretapping laws have been shot down when it comes to videotaping the police for this reason.

    The public police acting in a public capacity in clear public view or on public roads have no reasonable expectation of privacy, therefore videotaping is legal in all but those two states.

  • @inkey2 Massachusetts is one of the two states that doesn't have the "reasonable expectation of privacy" clause in their wiretapping laws. Anywhere other than those two states allows recording of the police in public or in your private home because of that clause.

    In any state other than those two, you can legally record the police in public, and you can refuse the illegal order to turn it off (unless you are under arrest).

  • I always dial my voicemail with my mobile phone when I am stopped by the cops, and set the phone on the console. The entire exchange gets recorded on my voicemail server where the cops can't delete it. This trick has gotten one ticket dismissed because when the cop lied under oath at trial, ( I know, shocking). I played back the exchange for the court, and the judge dismissed the case. The prosecutor wasn't too happy with the cop, either.

For the officers saftey, when the guy taping kept moving around in the car they dont know that he may not be going for a gun.

  • The issue is not the fact that he is recording. How does the cop know if the passenger is holding a gun under, or taped onto the camera? That may seam far fetched to you but it is completely plausible IT HAPPENS. Traffic stops are one of the most dangerous times for cops, if they take their eyes off you it only takes a second to draw a gun and shoot him dead. If your fiddling with something or holding something and he cant see your hands, that will make him VERY nervous.

    A lawsuit like that can end the career of a cop, and may even strip him of his protected status, meaning he could be sued personally as well.

    Cops know this, which is why they generally don't harass those who immediately assert their rights. They know those people will act on police actions.

You can film on private property or in a place where you expect privacy such as a home with consent of the parties you are filming.   • I hope you aren't a lawyer. I have read the statement of two NYPD officers and they both say the opposite of what you are implying. If you are in public and someone tapes you, well there is nothing you can do about it. I have been a professional photographer for over 20 years, and I very familiar with this law. You can film anyone or thing in a public area, even if they ask you to stop, but not on private property (Stores, Malls, etc).

  • The press - are registered - they carry ID to that effect. And yes, in both the USA and Canada, there IS a law that prevents people from being videotaped, or audiotaped without their permission. You can, however, write down what you hear, see, smell etc... and tell anyone you please. If someone videotaped you being arrested, grocery shopping, or sunbathing on your patio and then posted it to youtube, I'm sure you'd have some issues with that. That's why there's a law to protect us all.

    Again, where is this law that says filming anybody in any way is illegal? I'd really like to know this. Broadcasting the tape on Youtube is a different story. Videotaping is not.

  • Like I said, can you please tell me the federal and state statute for videotaping? There are certain designated situations where you can't film anybody, such as in places of privacy (dressing room, bathroom), and on private property, but if I'm in a public court and I want to film an old lady on a bench, or a police officer beating the crap out of somebody, there's nothing preventing me from doing so.

  • Either the judge was 100% wrong, or you made that up. Not only do citizens have the absolute right under the 1st amendment of the US constitution to do so, they have an obligation to do so. Freedom of the press...and NO you don't have to be a card carrying member of the 'press' for this to apply. You have a right to document, film, take pictures of any government official performing his duty in public. If a cop asks you to put the camera down 3 or 4 times, I would probably do it, though.

  • I still got the audio clip...I ain't bsing. In Oregon, if you are pulled over by a cop, you cannot record without the cops authorization...That's what the judge told me. I don't know about other states...but that's what is oregon law. Now if you can back it up with some more legal info, I may have a case...what do you say??

  • Im talking about federal law. The 1st amendment. There isn't a state law in the union that can take precident(spelling?), over the constitution. That's the way the constitution is structured. It covers the civil liberties our forefathers though were the most important, and lets the states cover anything that isn't federal law. Your right to videotape the police is covered under the 1st amendment. If Oregon has a law that prohibits you, then the law ITSELF is unconstitutional.(more in next)

  • I don't know if you have a case, because if it is a law, like you say, then the judge has to follow it, no matter what. The law would have to be changed first. This is one for your local ACLU. Please don't take any of this as legal advise. The cop asked you not to touch the camera. That became a lawful order. When you disobeyed a lawful order, the cop had reason to search you. So this is complicated. My sole reason for commenting in the first place was to say that taping is your right.

If we stand by our constitution, then there shouldn't be any issue at all whether or not the person in the rear of the car was recording what was going on.

  • I think the guy's idea of having the camera going in the first place was for the hope of inciting a police reaction. Then they will usually edit the clips to show their side of the story. Why do people have such a difficult time obeying the cops? It's a simple request by the cop This moron just wants to make his attempt at fame by being the next idiot that sues the police with a frivilous lawsuit for something he started.

  • I think you are correct. You are allowed to video tape cops, BUT if a cop tells you to do something, for example, put the camera down (still allowing the video to run) you have to that. Its for his safety. Then the guy kept grabing the camera and lieing saying he wasnt. The man in the car should be arrested for not following the orders of the cop!

  • Dumb kid will lose any trial proceeding. Several times he disobeyed lawful commands to put the camera down, which is obstruction of justice. The officer can simply articulate that the camera was a distraction and that distraction jeopardized his safety. CASE CLOSED

  • This cop had no business taking exception to the video cam. A citizen has every right in the world to film anything that happens in a public place, cop or no cop. Sue this creep!!!

  • That isn't the issue. It's dark out and the cop wants the guy's hands where he can see them. The guy kept reaching for the camera, and the cop has no way of knowing what he's doing with his hands out of view (like hiding drugs or reaching for a weapon). The camera isn't the issue ... the person's disobedience to a lawful request was.
