  • California is a weird state. So people be very careful when following any of this NON legal advise.

    Some states all driving infractions are criminal offensive and you can be brought to jail for them. Yes you can go to jail for failure to put on your turn signal and your car will be towed. You then have to pay for that towing and bond, so you really do lose. Do what you want, but be very leery of using California as an example. Did you win or did you pay and can you give the info?

  • When you sign for your licenses, you agree to surrender it upon request from a law enforcement officer, you agree not to resist a field sobriety test, and you agree to follow all laws pertaining to the vehicle code. You also agree to sign the ticket for you understanding that you have to appear, this is not admission of guilt. I hope no one follows this idiot’s advice.

It's like this... the ticket, whether speeding or parking or similar, is NOT a fine, it is an 'offer'. This is corporate contract Law. They are offering you the chance to give them money for the privilege of you doing whatever it was you did. You DO NOT have to pay. All you have to do is reply with a counter-offer. I always offer zero.

I then send them notice of my offer to the original company and mention that the matter is in dispute and that I've notified the local Police that the matter is in dispute and any attempts to gain access to my property or to take any of my property without my permission will result in charges.

    That's the end of the matter!

The court in each case states they had probable cause to stop the vehicle. Whren v US, US v Simpson, and US v Blair... pwned

If the cops DO show up, they are under NO obligation to answer any of your questions except when on the witness stand in regards to your case(s). Good luck getting them to answer the non-sequitur questions you ask. If you really want answers, why not do something productive like submit some FOIAs for actual public records that exist???

  • How do you get so many tickets in California? Also, how often do any of these ideas actually work? As for traffic cases in California, they are NOT civil. They are Civil-Criminal; it's different! They ARE basically criminal with civil penalties & you do NOT get the full protections of criminal law i.e. No Trial by Jury. You also don't have to agree to a contract or cause harm or have a victim; these are legislated crimes for no other reason than there is a stupid law that says they are.

That signal switch is not for decoration, it is meant to be used so use it and stop breaking the law.

If I stop a vehicle for a violation I write the summons, because that justifies the stop. Also the person was not seized, but the evidence was. But it was a good try

If someone were to walk into one of my states traffic courts and say that they "needed a contract" and "show where it applied to me" all one would have to do is open title 23 on the second page.....   • @lionel21000 .... They do. However, if you know how to research, you will be able to find that every state laws that are violated by the police, da, or judge if not all 3. Point them out and you will win every time. If you dont win, atleast you can take them to federal court for a few hundred dollars which is usually less than the fine. So, problem solved.

  • @Tactikalguy1 Really? To go through the appeal process in my state means that you have to show the magistrate ruled in appropriately and then go to a judge in probate. Its a civil violation. If the judge there rules against you, there is no more appeal, its not criminal. The only way that a federal court could come into play is if you can prove that the officer has violated your civil rights. Appearing in 3 different courts would cost a lot more than a ticket.

  • @lionel21000 .... To go to federal court you do not have to go to an appellate court. So, if a person can prove that the officer violated their civil rights, 400 is all they would need. How is that more expensive than a ticket? You must not have gotten one lately.

Complain all you want about thinking that a turn signal isn't a big deal, but consider how you'd feel if you were walking across a street not knowing someone was about to turn into it. Also consider how you would feel if you were driving and someone just shot into your lane inches in front of you. People deserve a warning before a vehicle enters a traffic lane that they're on. Not giving that warning is endangering life

    You're in a car, a car that you are PERMITTED by the state to drive. Not given a natural born right. The state gets the charges to press and they press them, unless it's a small traffic ticket then its a city mater unless it goes to county and ultimately are all pressed by the state sense they take care of all final legal state permitted maters. Its just up to the court to say if the charge was right.

  • @whiskeydence02 But in the end the state makes and enforces the final outcome of the laws and charges to go along with those laws. Witch means bone head it is in fact a state mater. Once the STATE signs the documents and seal you are in fact legal to prove you have done nothing illegal. If you can do so and you get charged anyway you may then take it to supreme court and they will decide if you have done nothing wrong, sign an appeal and you may fight it there. Good luck :)

  • @nerys71 Roadways are not mentioned in the constitution. The Roadways are built and maintained by the government and therefore they have a duty and obligation to maintain safety and order there. I'm not a constitutional lawyer but I'd imagine it would fall under the general well being of citizens. Part of this is requiring a license for operating a motor vehicle which incorrectly used can be a weapon. Part of this also is having laws in place for operating those vehicles.

  • @nerys71 Just to piggy back on this, It is Article 3 of constitution that states that anything conflicting with federal law is not withstanding if I am not mistaken. It get's tricky when you talk about equity law because it is a states version of common law to loosen the rigor of the constitution and any treaties in effect.

  • @nerys71 You can legally use public roadways without a license all day long...as long as you're walking or riding a bike. BUT, operating a motor vehicle on public roadways (the construction and maintenance of which is governement-funded) requires a valid drivers license, among other things.  The license is only mandatory if you wish to enjoy the *privilege* (not a right) of driving a car on those roadways.

    The automobile is the most common conveyance in history second only to your feet.

    My problem is not with licensing. My problem is the onerous ID nature of licensing and the penalties abused that have nothing to do with driving.

  • @wshester Once again. you needed no license or permission to take your horse on the public roadways nor your carriage on the public roadways. The only difference between horse and carriage and your car is the level of mechanization. nothing more. They are perfect analogs.

Your state legislatures have the RIGHT (under the constitution) to make laws that they see fit that will be best for the state.
