The biggest fallacy of this crap is that if the driver were paying better attention, they would avoid the accident altogether. Doesn't take into account different braking distances with different cars either. Also, to hit someone at 30 mph, you initially were probably traveling 55+ because of the braking.

@sociopathicregret But think about it, it depends on the situation lets use an old situation, a kid can just come running onto the street, the reason you did not detect him earlier is because he was behind a bunch of bushes and just darted onto the street, so if the driver was driveing at normal speeds, the driver would have caused less dammage apon the child. because if you tryed to swerve it by breaking and turning the wheel u'll just squish the kid and ull most likely be hurt as well
