Even if the merging car didn't have his turn signal on, it is definitely only the other driver's fault, since he wasn't even looking in front of him. Turn signal on or off, he would have been rear-ended anyways since the other driver wasn't able to notice a car in front of him, let alone a little flashing light.

First of all, using a turn signal isn't mandatory in all places (it may be in Moscow); even so, the car didn't just "all of the sudden" pull into the next lane, it actually eased into the other lane w/out signaling. Even w/out using a turn signal (which indicates your intention) the dumb ass driver approaching his rear didn't slow when it was clear a car was in his lane. Cause of accident = car that hit from the rear. He wouldn't have seen a blinker if he can't see an entire car ahead!
