In backing off her claim that a wise Latina would make better decisions than a White man, she called attention to the fact that it was nine White justices of the Supreme Court who sided with the plaintiff in Brown vs. Board of Education (effectively making school segregation illegal). Yet she used the excuse of following "precedent" in not overruling a lower court in the recent Ricci case. Should the Highest court have done the same?
