Arg! They have the character design for tails in the game, why couldn't they have just made him a character D: There's probably some way to make him playable by giving him someone else's moveset.
Because Sonic was included by a Japanese fan poll, which would only include one fan decided 3rd party character. Snake was in because the people from MGS begged for him to be in Melee but it was too late, so they put him in Brawl. Also, Tails would be cheap.
