What is the definition of "sexually dangerous" and who determines it? Are the standards different for each state, or is there a federally mandated definition? If it is limited to a rapist/murderer and crimes of that nature, then it makes sense. But if it applies to the guy who is found with porn on his computer and it's his first offense then it doesn't.

OMG. I actually agree with both rulings.

One of the things these two cases have in common is that state & the people have an interest in treating certain groups differently. This is obvious when it comes to people under the age of 18. But it is also true for those who shown that they are incapable of controlling their sexual predatory impulses. Sexual predators are often not your common criminals. They are driven by impulses they can't always control. This is why they can be kept locked up.

Also "sex offenders" is a vague term that includes being drunk and taking a leak in public one night, which can completely ruin your life. Not to mention the growing number of people realizing that women falsely accuse their ex-husbands of molesting kids in custody battles.

So if they're held AFTER they serve their sentance, they cross over into being held without charges, which is actually against the bill of rights and appeals to emotion, not law or logic...

I'm not wanting to be easy on dangerous people, but if you want to keep them behind bars AFTER their punishment is done, you do it according to the law or some other legal means, not because you're out of ideas.

If you're labeled a sex offender, and you are required to register for life in the state in which you live, your life is already BEING DETAINED INDEFINITELY. As long as people like: Oprah, John Walsh, Nancy DisGrace and Dr. Phil continue to promote distortions instead of facts, these silly, draconian laws will continue to pass and they will do nothing but trade freedom and privacy for a false sense of security and safety for Susie soccer mom that believes everything on Fox News.

Why not spend the money on treatment for sex offenders? Let them get jobs to pay for their own rehabilitation. This way, they can change their irrational and harmful beliefs that lead them to these actions and not be a financial burden to society.

By ruling to uphold prisons' ability to hold sex offenders indefinitely, the court could eventually set into motion a dangerous precedent that would allow prisons to hold any criminal indefinitely.
