Yah, I have made at least 12 videos that have been shoved off right away because of them. I have relized that the companys that claim the copyrights, don't really care if you take them and modify them for entertainment, but Viacom has the copyright and thinks they need to remove your video. Sometimes I can edit around it, but most of the time they just send there dumb little message. This video has been removed due to a copyright claim by Viacom. I seen it oh so many times.

More- Today, I saw a person in front of a local store, selling CD's and DVD's. He had over a thousand, most of it pre-release stuff! Now, that is the real problem!! And, I don't think he got those off of YT!

It goes like this - V creates The Daily Show, which becomes popular enough to generate TV ad revenue. Then people post clips on YT, so a portion of the TV audience now watches TDS on YT, diminishing the TV audience and therefore driving down ad revenue. However, now people are watching on YT which generates new ad revenue, which basically replaces the lost TV ad revenue. Shouldn't Viacom get some of that?

Uh, what? You sort of made my point. If people are turned on by a tease they see on YT, then they'll turn in to see the whole show. Also, why doesn't VC tap into the advertising revenue from online downloads? It just seems to me that there's a better way for VC to cope than through litigation. You can watch complete shows from any network, most without ads. By the way, nice chatting with someone with a mind!

Wow, I guess I need to read these things more often too. I did the whole 3 years, and I'm a practicing copyright attorney, so I do know a thing or two about the issue :) Agreed that new media has changed the paradigm, but I don't believe that good content will be produced without the financial incentives provided by copyright law. Intellectual property (whoever the owner is) deserves to be respected and protected just like physical property, and I do believe that is for all of our benefit.

I agree with you to a point. I, too, have a property that I have paid to be copyrighted with the Library of Congress. And I would be very upset if my idea was stolen and someone else made all the money. However, if a portion of that story were posted, and that posting made more people aware of my story, causing more exposure, I'd love it. My main purpose in posting these videos, has been to accomplish this very forum of discussion.

Glad you opened the forum - this is one of the more civil discourses I've observed on YT. The argument you just made is a common one, and seems compelling at first glance, but shouldn't you as the (c) holder be able to decide whether it gets posted or not, even if not posting it is bad for you? And what if, instead of making people more aware, it just made people come here to consume the content instead of purchasing it?

Lastly, while you may need the exposure at this time, Viacom, for example, does not. They have created a demand for their content so that people anticipate the next release, and they should be able to take advantage of that demand without being undercut by YT.

Just re-wateched your video after posting that last clip, and I want to respond to something at the end. You seem to feel that there is something wrong, or at least greedy, in Viacom wanting to capture the advertising revenue being diverted from traditional media. Have you considered that the very reason for that diversion is the presence of copyrighted material on sites like this?

I need to start reading these things more often. How long were you in law school? The point, and it is valid, is that the way all forms of entertainment are distributed is undergoing a major revolution. New ways will evolve to meet those demands. The final 12 episodes of 'lonelygirl15' was a major news event. To quote of of my favorite people- "The times they are a-changing"! Get on board or move over- and yes, even a mega-billion dollar entity like 'Viacom' can lose out.

Interesting, but the fact remains that YouTube is making a lot of money off of Viacom's (and others') property, while at the same time diverting their audience away from the channels that provide compensation for the use of their content. Viacom has built that audience over the years by providing content that people like...tell me, why shouldn't they share in all the money being made?

Maybe V should use YT to their advantage - but shouldn't they get to decide whether to do it or not? Or let's say Site A offers to share ad revenue with V and Site B does not. Shouldn't V get to say, "OK..A's gonna pay us for our content, so let's let them use it. B's not gonna pay us so we're not gonna allow them to use our stuff and lure viewers away from A"?

Also, I'm willing to bet that they are quite aware of your genie out of the bottle thing...in law school we used to say you can't unring the bell. I doubt they are under any illusion of stopping sharing completely (tho filtering is improving), they just want to be fairly compensated for the use of their property like anyone else.
