What Libby did that was wrong was cover it up and then lie to the FBI and perjure himself to the grand jury about the whole thing. It was very clear at the beginning of the video what Libby was investigated for and ultimately convicted of. At no point in this video did he say or even imply that it was Libby that outed Valerie Plame Wilson. However he was involved in the process.

  • @alefacepay It was more than just a perjury charge. Two counts of perjury, one for obstruction of justice, and one for lying to investigators. All of which are felonies, btw.

The others he was convicted on were one count of obstruction of justice and one count of making false statements to the FBI. So his crime actually was "more than a perjury charge."

  • There was undoubtedly a directive on this one. What's most amazing to me is this. For at least the past few years FOX has been rightfully criticized for its bias, yet nothing changes. Every single time I turn on FOX, I expect to see something that's just a bit more balanced. Doesn't happen, though. It's amazing and should be illegal.

  • As a covert agent, Valerie Plame did not have any diplomatic immunity or protection if she was caught while doing her vital national intelligence work. To repeat, this was work involving the international flow of nuclear material. You know, things like stopping the flow of WMDs into the hands of terrorists.

    Intelligence operatives also don't work in a vacuum, perhaps one day we'll find out how many other operatives working for the US were compromised.

  • No, he was convicted of intentinally misleading the investigator (obstruction of justice) and lying under oath (perjury). The judge, a Repbulican, stated that the evidence against Scooter was "overwhleming."

  • I've listened to this a lot, and to the comments made and I've changed my mind. While Fox is clearly the most managed source of inforation on the air, in this case I think that the reporter stumbled when she said "severity." She should have said "serious nature" or some such phrase. It is the serious nature of what was being investigated that makes Libby's obstruction of that investigation warrent his sentence.

    Our justice system breaks down if anyone can lie to a grand jury any time they like, and is never punished for it.

  • No, I don't, because I'm not squatting on publicly-owned radio air spectrum, as broadcasters are.

    Cable TV and the internet are entirely conducted over private, not public, wires.

    That's not to say that standards on cable and the internet are not admirable. I just don't consider them enforceable by governments.

  • Federal law *requires* regulation of publicly owned airwaves to ensure that they serve the public interest. That spectrum is public property. Spectrum users are allowed to make a profit off of it in exchange for meeting public needs.

    Why, exactly, would you want the government's regulatory responsibility expanded to cover cable and the internet? No public spectrum is involved, and there's no law in the US granting government such a role.

  • It is not beyond the reach of government to define internet bandwidth "public" and to pass such legislation. That would be consistent with historic Interstate Commerce Clause interpretations. So, it could be done. My view is that any such control (including goverenmnt content control over broadcaset media) is a bad thing. The consumer must become more sophisticated and alternate voices unsuppressed.

    But no regulatory hand for broadcasting is not acceptable to me, because CBS and NBC and Fox and ABC do not own the airwaves they are using. I do, and my fellow citizens. It's a public trust, and it comes with strings.

    The government *could* poke its nose into the tent and regulate, say, internet content, or telephone conversations, or what we say at a barbecue with friends. I'd prefer not to see that happen.

  • Your position is consistent with the historic treatment of this topic. I'm taking the more libertarian position that any government interferance with the flow of information is a bad thing. My rationale is "Type I - Type II error analysis" The potential abuses of an unregulated information distribution system are less dangerous than the abuses of a regulated information distribution system. 1984 is still relevant literature.

  • I'm sympathetic to your view - until it's applied to a broadcaster who squats on airwaves you and I own, and then uses that resource to advantage a particular political party.

    There isn't very much public spectrum available, you know. Anyone can't just jump in and start broadcasting. By its nature, it has to be regulated - otherwise a multitude of signals would simply jam each other out of existence.

  • If you limit your arguement to assignment of frequencies and broadcast wattage limits, of course I agree. But if you expand your argument to include content our opinions diverge. There was a time when access to broadcast spectrum equated to market-share of information flow, but now the broadcast spectrum is growing increasingly trivial. Do you get your TV signal from an antenae? Do you know anyone who does?
