If the checkpoint is established solely to look for intoxicated drivers (which has been deemed to be a threat so grave that constitutional protections against random stops should be waived), then the officers at the checkpoint should look for that. See if the driver is impaired. Done.

the other night i had a beer to drink, so better safe than sorry i let my friend who doesnt have a license drive my truck back home with me. so as we are driving down the road we fall into a police checkpoint. he gets a ticket and my truck gets impounded. im told that i have to wait 30 days to get it back and pay the impound fee. is there any other way for me to get my truck back sooner than 30 days???
Well, there is a couple of things you can do. However, that is not the problem. the problem is when the shit hits the fan, will you keep moving foward or just freeze up. I have talked to many that say i need help I will do whatever, but as soon as handcuffs are put on to scare them or they are lied to, they quit and shut up. I am tired of that.

I think that when it cuts across the line (as it often does) I am one of the few that speaks up about it. My cousin is a former US attorrney. He and I speak often about that line. His advice is always: "Don't break the law, but KNOW your rights (and law) so you are not taken advantage of. Watch what you say, etc."

I am actually working on a packet that if the officers ever stop me at a checkpoint of any kind,I will be filing criminal charges and going after their house and boat.If they have one.Cops follow policy and get away because people do not know the law. However, all it takes is one cop or a couple to get not only the department in hot water but the city as well.How is it that you have to test negative for alchohol or any drug? You dont. The Constitution of the United States pretty clearly says that police can't just stop someone and conduct an investigation unless there are "articulable facts" indicating possible criminal activity. So how can they do exactly that with DUI roadblocks?Good question. And it was raised in the case of Michigan v. Sitz (496 U.S. 444), in which the U.S. Supreme Court reviewed a decision of the Michigan Supreme Court striking down drunk driving roadblocks as unconstitutional.
In a 6-3 decision, the Court reversed the Michigan court, holding that roadblocks were consitutionally permissible. Chief Justice Rehnquist began his majority opinion by admitting that DUI roadblocks (aka "sobriety checkpoints") do, in fact, constitute a "seizure" within the language of the 4th Amendment. In other words, yes, it's a blatant violation of the Constitution.
This is legal or they wouldn't do it. I for one fully support any police department doing DUI checkpoints. If it means one less idiot off the road because they are intoxicated, then that's a good thing. I just found out that if there is a checkpoint, it is because the state gave that department the AUTHORITY to do so but with strict guidelines. I would check those guidelines to see if they were followed. I guess I would do it by finding out where to get those guidelines under the open records request which mean that if I ask for it I get it.

I am actually working on a packet that if the officers ever stop me at a checkpoint of any kind,I will be filing criminal charges and going after their house and boat.If they have one.Cops follow policy and get away because people do not know the law. However, all it takes is one cop or a couple to get not only the department in hot water but the city as well.How is it that you have to test negative for alchohol or any drug? You dont. They have to get a positive. The only way is if you consent.

I was stopped and refused to test, based on our 4th and 5th Amendment rights, it always amazes me the reactions people have it's always the same reaction, i.e.; "refusing is admitting your guilty" no actually refusing is invoking your 4th and 5th Amendment rights and pronouncing your innocence... we do not have to go around proving our innocence .
The reason we have a Constitution is because the Government regards everyone as criminals, our founding fathers knew this.

again... is it such an issue for police to pull drunks off the road that can kill people? whats 30 seconds out of your drive home to stop and show that your not drunk. it saves lives genious. big deal about the 30 seconds...don't drink and drive, and you won't have to worry about it.

The Constitution of the United States pretty clearly says that police can't just stop someone and conduct an investigation unless there are "articulable facts" indicating possible criminal activity. So how can they do exactly that with DUI roadblocks?Good question. And it was raised in the case of Michigan v. Sitz (496 U.S. 444), in which the U.S. Supreme Court reviewed a decision of the Michigan Supreme Court striking down drunk driving roadblocks as unconstitutional.

In a 6-3 decision, the Court reversed the Michigan court, holding that roadblocks were consitutionally permissible. Chief Justice Rehnquist began his majority opinion by admitting that DUI roadblocks (aka "sobriety checkpoints") do, in fact, constitute a "seizure" within the language of the 4th Amendment. In other words, yes, it's a blatant violation of the Constitution.

This is legal or they wouldn't do it. I for one fully support any police department doing DUI checkpoints. If it means one less idiot off the road because they are intoxicated, then that's a good thing. I don't drink and drive at all, so I don't have to worry about rolling through one of these checkpoints. Good for the cops!!!!!!

I'm sure the police have already checked all that stuff with the lawyers and the various D.A.'s across the country, so I don't have to worry about that. I fully support the police in doing these various DUI checkpoints. I wish they would do more of them!!! I like seeing morons and idiots go to jail because they are driving intoxicated. If you are stupid enough to drink and drive, then you are stupid enough to go to jail. Follow the laws and you will have no problems.........simple.

You don't need to be stupid and drink and drive, all you need is red bloodshot eyes, slurred speech and terrible balance, you will be charged with a dui... this happens to honest law abiding citizens everyday. In my case I performed in a skateboard demo, then went swimming in a chlorinated pool.
I was exhausted. I went home got stopped, and accused of a dui. Police don't need to smell anything either. I had to spend over $10,000 to clear my name... this could happen to you, Know your rights

You are as stupid as you sound. Pee in a cup, breath into a machine, or give as much blood as they want to determine you Blood Alcohol Level. The cops can't just arrest you for DUI without at least those procedures to back them up. If you blow below a .08 level, then they have to let you go without charging you. I've been through it before myself, I blew a .00 and the cop told me to get lost. $10,000 to "clear" your name is ridiculous, get out of here joker.

You've got me wrong there buddy, I'm All-American to the core!! It's just the fact that I follow the laws of this country, state, and county. Therefore I have nothing to hide or worry about when the police wishes to stop me. So if they want to stop me because they think I'm driving drunk, then fine. I'm more than willing to show them in every way that I'm not, and I have nothing to hide. How about this concept?? Don't break the law, and you'll have nothing to worry about either..get lost!

I just found out that if there is a checkpoint, it is because the state gave that department the AUTHORITY to do so but with strict guidelines. I would check those guidelines to see if they were followed. I guess I would do it by finding out where to get those guidelines under the open records request which mean that if I ask for it I get it.

You are right!They have no probable cause and therefore are harrassing the people they pull over.They can say that every 2nd or 3rd person gets pulled over but who is really counting it to verify?This is where who ever is in charge has the DISCRETION to do whatever she or he wants to do.Not every officer is evil but not every person is evil either.Yet as you see,the Glendale Police is still stopping everyone and detaining some.This is called a POLICE STATE.You are guilty until proven innocent.

Its unconstitutional, so yes it is illegal. They are stopping you with no just cause which is illegal. Also, its illegal detainment if they don't let you move on.
Look up the DHS checkpoints that are inside the U.S. past the border on youtube.
