Just as the comment implies the rule of law starts with the constitution. Specifically the federal government should be reigned in to doing only that which is constitutionally authorized in article one section eight. It's not a comment specifically picking on obama but the federal gov has no authority regulating, restricting, or over taking, things such as healthcare or education. If the gov. is allowed to do whatever it sees fit on any subject we no longer have rule of law but rule of man.
H. Care I might give you. But Education actually should be a federal matter. Every other 1st world country regulates its education system at the top level of gov't. As a matter of fact, just the hassle of moving from one state to another exemplifies exactly how broken our education system is.
Now, I don't think that the Fed Gov't should COMPLETELY take it over, but a standardized system would be a leap and a bound ahead of this sick joke that we call an education system now.

The congress and president aren't supposed to do whatever they want on any issue that comes up. They are supposed to abide by preset limits on their authority. If need be those limits can be changed but the founders made such changes difficult so some thought and effort would have to go into implementing them.

I mean, ok, Health care COULD be a state issue...could be. But speaking as someone who's faced one of the issues of the education system between 2 states firsthand, I'd love to see a regulated system. Something that set standards and goals, and provides the funding to back it up.

Well that's just the thing, national education (not NATIONALIST education) does fall under General Welfare. One cannot get far w/o an education these days, education in and of itself is grossly malformed, on a state by state basis there is no coherency, and quite frankly, matters generally become federal when issues cross state boundaries (which education does). By logical thought, education long ago became an interstate (or Federal) issue.
No you're trying to apply the words general welfare as giving the federal government purview over anything that could be construed as being for the benefit of the country. As Madison said general welfare as used in article one section eight refers only to the powers enumerated in article one section eight. Why would the founders write a document that specifically limits what the federal government can do and then include wording that implies they can do whatever they want?
Well I look at it this way. The implied powers are those for which situations have come up that the states might one day take on. But that's on a per state basis. Education is something that is NOT on a per state basis. General Welfare covers taxation does it not? And that in turn can (and in some parts does) cover education, and very well should.
We have tried and failed at that on a per state basis. If a loophole is what's needed to fix the situation, then I see nothing illegal about it. Think about it, we are practically the only country that does not have a nationally set standard for our education, and we are hurting for it. The states had a go at it. Now if a loophole like the one I just mentioned is what is needed, fine by me.
This does not mean they can do whatever they want, but in this case, what is NEEDED.
@AndrewDeLong A loophole is a legal means of circumventing the intent of a law. What you are suggesting is not a loophole but a violation of the written law. If you want to have education controlled by the federal government you need an amendment. Why not go through the proper procedure to change your government?
But that is just the thing, there is no real written law on education. Now I know that this normally would constitute the implied powers, but not in this case. Allowing a system that has proven to fail to continue is worse than any minor obstruction of the law. You know as well as I do that a procedure of that magnitude will never take place. Much like the drinking laws, if the Fed wants to get this done, it will have to throw it's money around. And of that there is nothing illegal....
If the Fed simply says, "implement these regulations or loose this funding related to them" on a per state basis about education, there is no rule or law I know of that makes that illegal. It's simply allowing what you just wanted, leaving the states to their business.
Hence why the Tax thing is not illegal, but like I said, a loophole.
Like I said, you and I both know amending the constitution like that most likely will not happen, which is a crying shame.

In effect it's saying "We fund your roads (highways) and we don't want that money wasted on road repairs due to underage drinkers...so if you want to maintain this level of funding, we suggest that you make the drinking age this --"
in effect, what I'm suggesting is no different. If any level of Fed. Funding is going to go towards education, then certain criteria and consistency should be met as a condition for getting/maintaining that funding.
If the states sign on, I see not one illegal act about it. It's all done under choice, not any forced level.
What works for the roads can work for the schools...in most basic monetary terms.

I'm well aware that it's common practice to put strings on funding as with highway funds but just because it happens doesn't make it right, proper or legal. It's not free choice if there is a manipulating force behind the decision.
I tend to disagree. The states know full well those "strings" you speak of. I prefer to call them qualifying criteria. Funding is as good as an investment in something. It is in the interest of the founder to make sure certain criteria are met when dealing them out (excluding block grants). It is no different with PELL grants for college. If I receive such a grant, I am expected to maintain a certain GPA to keep it. This is no different than what I am suggesting for standardized education
to clarify something...I meant to add that the states know full well of the "strings" but choose to take them anyway. There is nothing forcing their hand in the matter, they're free to take the funds, or leave them. The rest of what I intend to say is in my prior comment....

Just as the comment implies the rule of law starts with the constitution. Specifically the federal government should be reigned in to doing only that which is constitutionally authorized in article one section eight. It's not a comment specifically picking on obama but the federal gov has no authority regulating, restricting, or over taking, things such as healthcare or education. If the gov. is allowed to do whatever it sees fit on any subject we no longer have rule of law but rule of man.

Now, I don't think that the Fed Gov't should COMPLETELY take it over, but a standardized system would be a leap and a bound ahead of this sick joke that we call an education system now.

@AndrewDeLong Maybe it should be a federal matter but my point is that it isn't as the constitution is currently written. The congress and president aren't supposed to do whatever they want on any issue that comes up. They are supposed to abide by preset limits on their authority. If need be those limits can be changed but the founders made such changes difficult so some thought and effort would have to go into implementing them.

Well, yes I get that. But as I understand it, there are also implied powers that the Federal Government possesses, or, those powers not specifically allocated to one (the states) or the other (Federal). I believe that Education (unless I missed something) falls under the latter in a case such as this. H. Care might do so as well, but that is a 50-50 issue at best.
Still though, I do believe that the education system should be (and possibly already is) a Federal Matter.

@AndrewDeLong There are no implied powers. The tenth amendment was added just because some people feared that others wouldn't see the constitution as the limiting document that it is. "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." The general welfare clause is what congress refers to if they want to rationalize their illegal activity.

Okay, fair enough on the implied powers (an honest mistake on my part). But seriously, you wouldn't count education or Health Care under general welfare? I mean, ok, Health care COULD be a state issue...could be. But speaking as someone who's faced one of the issues of the education system between 2 states firsthand, I'd love to see a regulated system. Something that set standards and goals, and provides the funding to back it up.

Well that's just the thing, national education (not NATIONALIST education) does fall under General Welfare. One cannot get far w/o an education these days, education in and of itself is grossly malformed, on a state by state basis there is no coherency, and quite frankly, matters generally become federal when issues cross state boundaries (which education does). By logical thought, education long ago became an interstate (or Federal) issue.

No you're trying to apply the words general welfare as giving the federal government purview over anything that could be construed as being for the benefit of the country. As Madison said general welfare as used in article one section eight refers only to the powers enumerated in article one section eight. Why would the founders write a document that specifically limits what the federal government can do and then include wording that implies they can do whatever they want?

Well I look at it this way. The implied powers are those for which situations have come up that the states might one day take on. But that's on a per state basis. Education is something that is NOT on a per state basis. General Welfare covers taxation does it not? And that in turn can (and in some parts does) cover education, and very well should.

We have tried and failed at that on a per state basis. If a loophole is what's needed to fix the situation, then I see nothing illegal about it. Think about it, we are practically the only country that does not have a nationally set standard for our education, and we are hurting for it. The states had a go at it. Now if a loophole like the one I just mentioned is what is needed, fine by me.
This does not mean they can do whatever they want, but in this case, what is NEEDED.

But that is just the thing, there is no real written law on education. Now I know that this normally would constitute the implied powers, but not in this case. Allowing a system that has proven to fail to continue is worse than any minor obstruction of the law. You know as well as I do that a procedure of that magnitude will never take place. Much like the drinking laws, if the Fed wants to get this done, it will have to throw it's money around. And of that there is nothing illegal....

If the Fed simply says, "implement these regulations or loose this funding related to them" on a per state basis about education, there is no rule or law I know of that makes that illegal. It's simply allowing what you just wanted, leaving the states to their business.
Hence why the Tax thing is not illegal, but like I said, a loophole.
Like I said, you and I both know amending the constitution like that most likely will not happen, which is a crying shame.

in effect, what I'm suggesting is no different. If any level of Fed. Funding is going to go towards education, then certain criteria and consistency should be met as a condition for getting/maintaining that funding.
If the states sign on, I see not one illegal act about it. It's all done under choice, not any forced level.
What works for the roads can work for the schools...in most basic monetary terms.

I tend to disagree. The states know full well those "strings" you speak of. I prefer to call them qualifying criteria. Funding is as good as an investment in something. It is in the interest of the founder to make sure certain criteria are met when dealing them out (excluding block grants). It is no different with PELL grants for college. If I receive such a grant, I am expected to maintain a certain GPA to keep it. This is no different than what I am suggesting for standardized education

IDEA: members of congress should have mandatory tax audits every 2 years. If they don't pay up (+penalties) in 3 mos., they loose their seat. If they pay, but it happens 3 times..they're OUT (no re-election possible). Americans would trust congress a little more with this regulation in place, knowing they pay their taxes like we pay ours! This may go down as the worst State of the Union Address in history. The current administration tripled the national deficit, nearly doubled the unemployment from the average during the Bush years, and nearly bankrupt the country on failed stimulus while focusing on nationalizing health care and energy, but blamed the previous adminstration for all of his woes. President Obama could not get himself to admit we won in Iraq and inappropriately attacked the Supreme Court all in one awful speech.
