The supreme court can see cases such as police brutality, and as crazy as an inmate fighting the death penalty. The justice would then look at the constitution and interpret what is written and make a ruling based on what the constitution. No court rules on anything unless it is clearly stated. For you to think some justice makes a ruling based on his heart felt sympathy is just completly obsurd and lacking education. You need to argue with someone who don't know law maybe you could win!

Federal law already prohibits discrimination by contractors and requires union-level wages. Why not monitor these cases too?

The Supreme Court decides what is and what is not constitutional, no one else (BTW, it is the Constitution itself that appoints the Supreme Court as the ultimate authority).

The constitution suprecedes state law unless the state law in more stringent than that of the federal level. Look at the many handguns laws for our example here. The supreme court can see cases such as police brutality, and as crazy as an inmate fighting the death penalty. The justice would then look at the constitution and interpret what is written and make a ruling based on what the constitution. No court rules on anything unless it is clearly stated. The Supreme Court *DOES* decide what "is" and "isn't" Constitutional. They do this by *READING* what is before them and making judgments accordingly.
They don't argue over bullshit word squabbles like the difference between "interpreting" and "deciding" (like you, yourself do.)

sheesh...this is a really difficult vid to watch. As the woman (women) who have experienced such physical & psychological trauma are repeatedly victimized by the laws which were enacted to protect them or to, at the least, empower some justice. He did ask her of what was her understanding of Mr. Obama's character for having not supported such a vote. This comment, in some ways, was a snapshot of how there are many harsh sides to this issue. None of which are helping these victims. :(

Hey, you're welcomed to explain why the amendment is so awful, but Republican senators have already tried to suggest the amendment is unenforceable, and they've been roundly mocked for it. Now they're saying they're just going along with the DoD, which said it has no way of knowing whether its contractors had such employment practices - a fatally weak argument. Federal law already prohibits discrimination by contractors and requires union-level wages. Why not monitor these cases too?

Some of the Dems who lost the elections yesterday were ones who ran especially nasty campaign ads against their Rep opponants. Negative ads hurt the side that runs them more. I wouldn't recommend running ads or robocalls about Vitter supporting rape. They will backfire.

NO, it is time for you to stop the horseshit. The bills intention is to guarantee that KBR no longer gets defense contracts. The wording says no contractor will get government contracts if they require victims of sexual assualt to arbitrate. No victim should arbitrate and I stand by that but it should be made law that no employer may require that and I STAND BY THAT. All KBR has to do is allow due process to take place instead of favoring arbitration and it applies to ALL contractors who mandate an employee or independent contractor to resolve civil rights violations through arbitration. BTW, due process IS a constitutional right, (why is it conservatives never seem to know anything about the constitution?) but many companies use arbitration to circumvent this right. A great friend of mine still lives in Michigan, which has the highest unemployment rate by a long shot. Lets take a look at why. One main reason is they have a riduculously high tax rate there. He pays $1600 a year tax on a double wide and 10 acres together assesed at $80,000. I have a 2 story home on 1/2 acre assesed the same and pay $40 a year. See the trend?

The problem is the high tax rates in known over liberal states. Michigan historically proves to at one time been of the most highly sought after state to live in. People wanted to work for the big 3. All of the big 3 operations were in that state only. Now due to such high taxes they and most other big corperations have vacated the state. This is a sad situation. Louisiana has unemployment well below the national average with less taxes. Now chew on that before you knock a conservative!

The Supreme Court decides what is and what is not constitutional, no one else (BTW, it is the Constitution itself that appoints the Supreme Court as the ultimate authority).

I do not steal from people and I work for a living therefore I am not scared of someone who owns a gun for their protection. The constitution says NOTHING about justifiable homicide, if we just took the constitution at face value their would be NO such thing, for it would be unconstitutional. So when the decided their was such a thing it was because of ACTIVIST judges. My point was that if you took the constitution at face value it'd be SO hard to get search warrants & convictions. Criminals would be let off left & right if it wasnt for activists judges.

I never said anything about an activist judge doing anything the guy I replyed to did. "Activist Judges" are illegal as it is a conflict of interest in the duties of their job. At the end of the day the Constitution *supersedes* the states, however.
It was because of this that Abortion was ruled *legal* by the United States Supreme Court,...and that is just one of many examples of where Federal Law supersedes state law.

I have been trying to tell you this the whole time. I am saying if something is unconstitutionaly then you file a suit in court and the judge would look at the constitution and see that it is in fact uncontitutional. I have been trying to say that judges are not sopposed rule something unconstitutional based on their political views. They review the constitution and the bill and other pertinent laws to make that ruling. I do not get where think I am stating other wise.

I have been trying to tell the folks that the judge does not say what is unconstitutional on whim. He or she has to do a lot of homework. The they write an opinion based on what laws they have including the constitution and bill of rights. So if thats what your point is in a piss poor choice of words, then I would finnaly agree now that you clarified yourself correctly. Which is what all judges do, and with almost every decision they make *someone* jumps up and screams "activist judge" when the decision they rendered (as you have said, based on the principles you outlines) doesn't agree with their *pre-determined decision* on what the outcome should have been.
*THAT* was the only point I was trying to make (speaking for myself, not anyone else who has posted). The whole term "Activist Judges" were created to describe the situation outlines above.

The constitution suprecedes state law unless the state law in more stringent than that of the federal level. Look at the many handguns laws for our example here. People of Chicago, and San Francisco are not allowed to even own a fire arm. Yet the second amendment cleary states they have the right to do so. But of course the liberal side is ok with the state and local levels dictating so as long it is conveineint for their agenda except abortions.
