  • You "common law rights" are not valid when you have SUBMITTED an APPLICATION for a UK DRIVING LICENCE which you hold. Part of the contract (which you must have signed when applying) states you must abide by all UK TRAFFIC ACTS & STATUTES. You also were driving a registered vehicle which in effect belongs to the person you registered it to (DVLA aka a GOVERNMENT AGENCY). You have not got a leg to stand on in regards to common law. As for the red light offence, I cannot comment.

  • Oh, just so you know, the reason that they will never give you the original bill is because without it they will be unable to take you to take you to court !!

  • as the bill was never duly presented. Have the notary public stamp the copy for protest due to lack of presentment and send it off to the 3rd party (whoever the bill is payable to) they then have a certain amount of time to prove that the bill was presented or re-present the bill. If they do not do this within this time the police officer who issued the FPN then becomes liable for the bill under the bill of exchange act 1882.

  • A fixed penalty notice that is being presented to you by a police officer is a BILL OF EXCHANGE. This means that if you refuse to accept it you dishonour the bill and are liable to pay it. This is what you must do: Tell the officer that you recognise the FPN as a bill of exchange and that you are happy to accept it providing he gives you the ORIGINAL (the part that has the pen ink on it) he will refuse and give you a copy. Take this copy to a notary public.........

  • If you signed the driver license application and possess a driver license and the benefit of registration you are contracted. You cannot mix Common Law with Equity Law. That's why these cops just keep proceeding. If you have a driver license, you are NOT under Common Law. Did he say 'DUN & BRADSHAW'? No wonder the cops just laugh at people. You are contracting with these guys with everything that comes out of your mouth. The driver license IS evidence of the contract that you violated.

  • @AceOfHeart2012 The drivers license is to be used should you contract to do business with the Corporation of London, AKA 'The Crown, AKA Her Majesty' as I understand it and is not needed to use the roads for private use.

Go read Maynard again Common Law is the law of the land because it is based on what is right, and I hate dickheads using it to pick and choose what they want to do! Also, this word "society". Stop using it as a vague generalized term for everybody. It means you are in a society, which is an organization (in this case The Law Society).

  • what gave you the right to film the police giving you your ticket? the same right anyone has to take a picture of anyone in a public space that is not used for commercial purposes (i.e to make money from) think about that before you complain about them taking a photo of you in a public space.

  • @TJrebelTV yes, the FPN clearly states that he can either pay the fine accepting his guilt, or challenge it in court where he MAY be regarded innocent but more likely not as the burden of proof rests with the defendant. if he can't prove he didn't cross a red light he will be more than likely found guilty and have to pay court costs and what ever fine the magistrates chooses.

He has the right to be judged under Common Law. Investigate the differences between lawful and legal. Common Law Vs corporate Maritime Law.

    The burden of proof does indeed rest with the defendant. But thats because the BURDEN of proof will REST once the case is SETTLED. Till then, the burden of proof lies with the PLAINTIFF.   • @TJrebelTV If the majority consents to be bound by a law which says a constable can photograph you and also allows it to be enforced through the courts on pain of punishment, then an offender has no moral or legal right to opt out by claiming he didn't sign on. In any case, once he opts out of any aspect of his default position as a member of human society, then he must also accept that he has opted out of all others. i would suggest you looked in to Kafka's "before the law"

Research Robert Mernard and John Harris as a starting point. Your example above compeltely ignores the wishes of those minorities who belong to a society outside corporate society. This guy has not opted out of "human" society in any way shape or form.

    - arrested by a constable for an offence

    - required to wait with a PCSO.

    - given an FPN or PND by a constable in uniform.

    - given a notice in relation to a relevant fixed penalty offence by a PCSO or accredited person (???)

    - given a Direction to Leave under S27 VCRA 2006

    he was given a FPN by the police

  • Also, am I right in thinking that if you fill in the form they give you, you are entering into a contract and will therefore be liable to prosecution, but if you don't fill it in, send it with an accompanying letter, when they fail to respond (which they will) that then they have breached any contract? I'd be interested to know as I am fighting a fpn for a scurrilous charge myself at the moment. Good Luck & Thanks if anyone can enlighten me.
