The constitution is pretty clear. The income tax is not unconstitutional. What is unconstitutional is a tax that is not fairly or equally applied. I think one could argue that a flat amount or flat percentage is constitutional.

However,the federal reserve, even if under the control of government, is clearly unconstitutional. The violations to the constitution without amendment would have our founders rolling over in their graves.

Actually, the original fed income tax was rejected as unconstitutional. Which is why the amendment was drafted. I will have to refresh my memory (college was over ten years ago), but the original intent of taxation was to never have a direct tax on labor.
