@Erikhaos naa it does count because the ball isn't out of bounds. Its officially out of bounds if the ball makes contact of anything out of bounds. In this case Kobe was in the air and the ball didn't touch the top or the back of the backboard.

@Erikhaos The ball has to actually touch something to be out of bounds, or touch a person that is touching out of bounds. The air does not count.
