I don't see how this segment is an argument against the death penalty. Frodo states out of emotion that he wishes Bilbo killed Gollum in the past. Gandalf responds that many who live deserve death, and some who die deserve life. Frodo is speaking out of emotion whereas the death penalty is decided out of facts. Gandalf responds to Frodo that judgement of others can be a dangerous thing. If the death penalty is ruled out of emotion then I could see the comparison.
@kamorm I agree with you. In any case, Tolkien was too subtle to include sweeping statements about death penalty in LOTR. This was written in the 1940's and we should not apply today's preoccupations and positions to it. We forget how very recent the tendency to pity the perpetrator more than the victim is. I doubt very much that Tolkien, a staunch conservative and Roman Catholic, would have been against the death penalty which is after all Biblical: a life for a life.

There is so much Truth and Wisdom in this Scene! Who dares to claim, he knows all the Ways of this Life?? So many of us boast out with that, but what can we really know? There are Forces in this World, we never can seize and determine... This Scene shows how to face this Forces. With Humbleness ans Love....
