To anyone claiming that the US Constitution is a 'living, breathing document', you're straight up wrong. The Constitution is a LEGAL DOCUMENT. We are not free to reinterpret contracts at our convenience, or any other law. Why should the Constitution, which was designed the way it was in order to protect the people from the government, be interpreted at the government's whim?

What keeps the government in check if we decide that it can choose weather or not it is really bound by the constitution?

@PingOnThis "We" can't reinterpret the constitution, this is a power held only by the supreme court. What is meant by "Living breathing" is that it can be changed, and indeed the founding brothers left open the option to do just that by establishing a procedure by which to make new amendments.

The SCotUS is the sole legal authority on interpretations, however. This does not mean that they are infallible in their interpretation, nor does it mean that no one is allowed to disagree with their interpretation. However, when the government starts acting in ways that are clearly in violation of the Constituion and the SCotUS is not properly checking the government, it is the duty of the people to replace that tyrannical government.

@PingOnThis I'm not sure what the disagreement is then because you've already conceded both of my points. The Governemnt (in this case the Supreme Court) is free to reinterpret the Constitution. The Constitution is a living Breathing Document. The only other points you've brought up are not in disagreement with anything I have said thus far.

this is some pretty silly revisionist history, the second amendment was created to allow states to organize their own militias that could not be disbanded by the federal government and therefore leave the state defenseless. even if one was to take an originalist interpretation of the constitution it would be disingenuous to argue that those who ratified meant for it mean that citizens can guns on their person at any and all times. most vital amendment? that's categorically false.

If they intended for only a well regulated militia, as you claim, the phrasing would have been: 'A well regulated militia, being necessary to the security of a free state, shall not be infringed'

The second amendment ensures militias by ensuring armed citizens, and it ensures armed citizens by ensuring "the right of the people" to "keep and bear arms". The founding brothers were very weary of establishing a standing army having suffered under the standing army of Britain, thus the emphasis on state militias. It is only revisionist to imply that the "right of the people" somehow doesn't apply to the people.

The US constitution is a living document that must be adapted and interpreted with the times. The framers had no idea of the weapons that would be produced and available in the future. To pretend that people should be able to walk around with whatever weapon they choose is laughable.

I do agree that people should have the right to bear arms. But people also have the right to be safe from some of the idiots who do bear arms. And there are a lot of idiots who bear guns...

@rahpiklz Well I was a permanent American resident for a while and now I'm a dual Citizen, but even as a permanent resident I served in the US Air Force and as my oath stated "I pledge to defend the constition of the United States of America" not whatever the constitution might be interpreted as or what it might evolve into over time. I've read it quite a few times and it's very specific and meant to be set in stone.
