Phil, if I was you I would make a video with as much copyrighted material as possible. Music, pictures, video, everything you can fit.
You're such a talented musician, I highly doubt any single music artist would personally object to your covers. Its time for the musicians to stand up against their record companies.
@peniosasdasd Oh thanks. That's really kind of you. Yeah, it's such a shame that the musicians themselves can't take action against the record companies. They have way too much control.
Ummm, easy solution dude, get a band ! your an awsome drummer and I think everyone that has subscribed to you would much rather here you play with a crackin band, then to a cd.At the moment, without a band i see you as a waisted talent.thats just my thought anyways!
Ok the what I would does make a new channel right now. The invite all your subs to sub to that one and start building from there. My friendliest his account for using an image from a movie and he had thousands of subs. His heart was broken and he stopped working on music because of it ( his stuff was all originals ). I think u should do an announcement video and then email every one of your subs. Keep this one but start a new one too.
@KCJacksonMuz Covers are what get the views though because people want the see how their favourite song's played. Sure, I've got original studio stuff I've recorded with band's I've been in but I don't think it's that interesting to others. I've got a few original videos up but they're never that popular.
@ChilliWalla I'm sorry Sir that business has gone in to liquidation. I'm sorry for all those people who used the service or had booked me and paid upfront. All we can do is apologise. This service is no longer available.
You've really exposed yourself in this video, I think you did a great job. Glad to hear that you're still alive and kicking. It really sucks with all of this YouTube copyright nonsense!
@Menello Thanks a lot. Yeah, I'm still around. Just about. I'll try and figure it all out and get back to what people subscribed to me for. It's just taking a while. Thanks for sticking around.
I have a feeling I'm going to get one of those emails soon. I've had a quite a few videos taken down and Youtube has notified me on a huge portion of videos about copyrighted material. They even said my "Luna" & "Rocket" covers contained copyrighted material, but it's all me playing the music in those, no backing tracks from CDs or anything, and I give credit that I don't own it and that it's a cover song, but I guess that doesn't matter? I don't know, that confused the hell out of me.
Well, it was fun while it lasted but this YouTube/Google unholy alliance really is beginning to suck. If SOPA ever passes then it's the end for sure. Then what will be left on YT, stupid pet tricks? They will lose MILLIONS of users like us, who showcase under "Fair Use". Maybe we should all get together and file a class action suit and get a definitive ruling one way or the other. Good luck, Phil! Just start a new channel and leave this one intact, is my advice.
@17drums Thanks Dave. Yeah, I was thinking of starting a new channel and leaving this ghost ship to run it's own course. You've got a point though, what the Hell will be left to watch on Youtube? Strangers Blogs? Advice on cleaning your car? It'll be interesting to see what happens next with Youtube next but as you said, it's been a fun few years and a lot of good has come out of it so I don't mind too much.
what the dick. i upload almost exclusively covers of copyrighted songs with the original song thrown in the mix, and i only ever get the "matched third party content" thing. sometimes, they block the video in some countries (mainly germany). only on very few occasions has a video of mine been blocked (a vocal cover of quiet off of vieuphoria, for example) or removed altogether (my cat kravitz eating a small rodent was way too brutal for youtube, apparently). might it be a UK vs. finland thing?
@finowa Haha! I missed the Kravitz video! Damn. Sounded fun. Yeah, for a long time I got the "Matched third party content" thing. But after a while, you get an email because they're pissed off with you. So look out, one may be heading your way sometime soon! It sucks, but what can I do. Just gotta think of a way round it. Thanks as always for watching though.
As a drummer, I often watch your videos to learn. I know that copyrighted music is allowed under "Fair use", and I know one of the "Fair uses" of copyrighted music is educational purposes. If you plan on fighting them, you could always make that point. Me and many drummers watch you, not only as entertainment, but as a learning experience; it's easier to watch you play it, then stare at the wall of text you find on a tab.
@GrockJake Thanks. Yeah, a lot of people have tried the fair use angle and cutting and pasting a paragraph about that sometimes works but they've basically told me they don't care about that and any more videos with music and they'll close my account. Thanks for watching my videos to learn though. I appreciate that.
What a load of shit. This is such fucking bullshit. Youtube owned by Google, Google oppose SOPA & PIPA, Youtube sends you effectively a cease and desist.
Yo, when I cover songs, I record me playing the guitar with the music playing through my speaker system. I only have a few songs detected as third party content but they haven't done anything to my videos. The song in the background is just quiet enough that it doesn't really get detected I suppose. I think when you upload the song it's self implanted into the video via computer work, it's easier to get detected, at least as far as I can see.
@Despotes518 It's a good idea. I guess it wouldn't be as easy to detect. The only downside being that'd you have to sacrafice quality to do that. It's a good idea though.
Phil I know I have only been in contact recently (PM) but thanks for all the superb videos and hours of drumming entertainment that you have given, particularly your Smashing Pumpkins portfolio which is highly impressive. I hope that there is some way around this that you can find to get some drum covers up but in the mean time I look forward to the drum videos & already liked the photography page! Dar
@skybluedar Hey Dar, good to talk to you again. Thanks a lot for watching the videos AND liking the photography page. Yeah, hopefully I'll find a way round the copyright thing. Thanks again.
i got one too the other day on a drum cover i done..had the music playin in the background thru my pa system,,,it was MY DRUMS and listed as MY DRUM COVER!! but i got an email saying it was copyrighted....im not selling nor using the music for anything other then entertainment,,not making any money what so ever from it...nor do i claim it was my music..youtube should just shutdown bcause theres 1000's of vids with other peoples music on here...its BULLS%IT! of youtube to be so f-kin anal.
@Metal4Life572 To be fair, Youtube isn't being anal. They are covering their asses as required by the DMCA. Did you write to your congressman in the 90's to oppose the DMCA?
And to be fair, legally, what you were doing is still essentially sampling. No copyright law in the US has an exemption for entertainment purposes. It isn't just a question of if you're making money.
I'm not saying this is the way it should be, but that's currently the law and Youtube is just complying.
I spent a good deal of my time at university studying copyright of music. The issue at hand isn't that you're doing "covers" as vkondras says, but rather that you're essentially sampling by playing along with a copyrighted recording on video. There's also an issue of sync licenses, but lets ignore that for now. If you're able to find other people to play the other instruments on the songs, you will 'probably' be fine to put up more videos. Message me if you have any questions.
@11111phil11111 Essentially, if you're just playing the music yourself, then you're only dealing with the "publishing" (P) copyright to the music itself, which you can use under a compulsory license. How that license works for Youtube (7.5cents per copy distributed) isn't something that's been addressed by current law.
Get the book by Don Passman "All You Need to Know About the Music Business". Its a great read, very accurate and will help you a ton.
Love your drumming, watched the whole video, too bad that the bastards don't understand the concept of covers and creating new art using other art as a background. I hope you can find a way around it - if not, good luck and thanks for the many hours of both practical and inspirational video!
@vkondras wow thanks. Yeah, I don't get it. I would've thought using others people's music was actually promoting them. I'm hardly SELLING their music to people. In a way it's like suing radio stations for playing their music. I don't get it. Thanks for watching the video all the way through though. Even I struggle with that.
@vkondras I think Youtube understands the concept of covers rather well. Yet, if you are using the recording of a song then it isn't just a cover, but a use that would require a mechanical and sync license for use of the sample.
Is this the way it should be? I don't think so, but this is the law. Vote. Protest. Write your congresspeople.
@Tibbon That's why I mentioned the art in the background - sure, he's playing the recorded song, but Phil is also drumming over it. Are they worried that someone will play Phil's recording and thus won't actually buy the song? That's ridiculous. And yes, I'm aware of what the laws are - my problem is with what they consider to be against the law - instead of catching people who are actually just posting copyrighted music on youtube(I disagree with that too, but at least it's understandable).
You could probably make an account on Blip, Viddler, or some other video hosting site. Then, you can post a 30 second or so text based message saying "hey, check out new video x *link here*"
Hi Phil, I've been following you for a few years now. I know there is a ''copyright'' paragraph that people use on their videos description regarding audio etc, "Copyright Disclaimer Under Section 107 of the Copyright Act 1976'' I have used the same method on some of my video's and it has got YT off my back, I'm not saying it will work for you, as I don't understand the complications with copyright but its worth looking into. @ElsolraSaul Firstly, thanks for following me for so song. I really appreciate that. Yeah, the cut n' paste paragraph about copywright and the 1976 act worked on a few of my videos and I thought that was the end of it and I'd fixed the problem but in their latest email to me, Youtube specifically said that using that paragraph isn't good enough either. Seems they just hate me. Thanks for suggesting it though. And again, thanks for watching
@ElsolraSaul i have that on all my drum cover vids too,but i still get the email saying its copyrighted material and blah blah blah,,,im not making any money off these nor am i selling it as my own stuff..its just MY DRUMS and my rendition of the drums for that particular song.
