OK, So I researched this incident and the state of Utah / Trooper John Gardener settled out of court for $40,000.00. Good thing because had I been on that jury I would have awarded Jared Massey 1.4 MILLION DOLLARS and given my recommendation that Trooper John Gardener be sentenced to no less than one year in state prison for assault enhanced by use of a potentially lethal weapon. When you hear about officers shot in the line of duty, It could be some asshole like this that deserves to be shot.
No matter what the citizen has done, he did not deserve to be tased or the treatment the officer did for the offence, also the officer MUST! Read you your Miranda rights after your suspected is in custody. and when he went into the car without a warrant he violate the 4th amendment. It is obvious that this officer needs to make up with his wife and stop taking it out on the public. For sure with his power trip attitude, he will come up against the wrong person one day! And receive his justice.

First off, that cop definitely did not have the car for speeding, which is exactly why he couldn't tell him the speed he was travelling. Hell, look at the replay and use some common sense - the cop is pulling over to the side of the road and it would make sense that the other guy was slowing down as he did so...The driver did NOT have to sign the ticket and there is no law or statute requiring him to do so. @saturn0660, wrong choice of words. it's not an admission of guilt. It's basically saying you will appear or take care of the ticket and if you don't you cannot say you didn't receive the ticket. Now if you don't sign the ticket you will be arrested in criminal cases. If it is a civil citation then you can refuse to sign the ticket and the officer will just note that you refused to sign. That's why I say, if he had informed the man of this, none of this happens.
It's real simple. You either sign the ticket, or you go jail. You can't refuse to sign the ticket, and then refuse to go to jail. These are not options for you. If you resist arrest, you will get tazed, and... you should! If you really want to dispute the charges, you can take up in court. But you can't say "I'm not signing that", that isn't an option.

They can hold you a full week, and fine you several thousand dollars. By the way, most countries are far worse. Your in one of the few countries where holding you in jail, and a fine, is about the worse. In Cuba, Mexico, and many others, you curse out a police officer, you could get beaten for it, and nothing will happen to the officer.

Then you get a hearing before a judge, who has the discretion to let you out of jail pending a trial on your ticket after making sure that you will appear (eg, bail).

Actually, I look at a lot of abuse videos, and this looks pretty tame. Most cops do a great job, and have good people skills. There are a few bad jerks out there, but to be honest, this looks like the cop pretty much went by the book. First off, that cop definitely did not have the car for speeding, which is exactly why he couldn't tell him the speed he was travelling. Hell, look at the replay and use some common sense - the cop is pulling over to the side of the road and it would make sense that the other guy was slowing down as he did so...The driver did NOT have to sign the ticket and there is no law or statute requiring him to do so. This cop just loves the power and you can practically hear him salivate about it.

Now if you don't sign the ticket you will be arrested in criminal cases. If it is a civil citation then you can refuse to sign the ticket and the officer will just note that you refused to sign. That's why I say, if he had informed the man of this, none of this happens.

It's real simple. You either sign the ticket, or you go jail. You can't refuse to sign the ticket, and then refuse to go to jail. These are not options for you. If you resist arrest, you will get tazed, and... you should! If you really want to dispute the charges, you can take up in court. But you can't say "I'm not signing that", that isn't an option.

They can hold you a full week, and fine you several thousand dollars. By the way, most countries are far worse. Your in one of the few countries where holding you in jail, and a fine, is about the worse. Then you get a hearing before a judge, who has the discretion to let you out of jail pending a trial on your ticket after making sure that you will appear (eg, bail).
By refusing to sign, a person is making the whole experience a lot more expensive for themselves.

Actually, I look at a lot of abuse videos, and this looks pretty tame. Most cops do a great job, and have good people skills. There are a few bad jerks out there, but to be honest, this looks like the cop pretty much went by the book. I do think that he could have been a bit more patient with the guy and spent some time explaining the man's rights. Now, how long will this post last?
