I guess the only question I have is what happens if an employer simply refuse to hire National Guardsmen or a Reservist in the first place?
As nice as the law is, I don't think that it has been written to account for employers who simply will not hire reserve/guardsmen in the first place. I've been applying to several jobs and even with my college education and my long history of civilian employment I can't seem to get any gig that pays above $26,000 and I already make that type of money now.
