The other player is clearly in an offside position. The second one seems to be offside, for his body's behind the defender. Not necessarily his legs, but his the rest of his body is.

As for bad refereeing during your game against Romania, the offside goal wasn't offside, but the penalty kick was a correct call.

I neither agree nor disagree to the first to: I can't recall having seen them. 2008: the player is participating, since he's left the pitch without the referee's permission. This means he's playing Van Nistelrooij onside. If The Italian player had had permission to leave the pitch, Van Nistelrooij would have been offside.
