Actually the rig was built and deepwater drilling back in 2002.
Obama's escrow account proposition was to create a pool of money in which the government would pay for individual damage claims for BP to back up later. Had the tens of thousands of damage claims been brought to the courts, it would have taken years before most of the victims saw any money.

I would totally agree save for companies like BP/Exxon that have lobbied for many years now to make "due proccess" work almost exclusively in thier best interests. There is a STARK difference between a restaurant slip and fall and an environmental and economical disaster of epidemic proportions. The international community would initiate a fact finding mission that would not yield results for several years. BP agreed that 20 billion dollars in an escrow account with no cap would suffice. Actually the rig was built and deepwater drilling back in 2002.
Obama's escrow account proposition was to create a pool of money in which the government would pay for individual damage claims for BP to back up later. Had the tens of thousands of damage claims been brought to the courts, it would have taken years before most of the victims saw any money.

The explosion occurred drilling at the Macondo Project site; BP didn't secure drilling rights there until March 2009. The Obama Admin approved April 2009, exempting BP's drilling plans from review.
If BP can back up damage claims "later", they could have also done so "later" after a full investigation to determine the actual cause & who was at fault. Other corporations are involved in drilling operations.

BP is telling the public the oil spill is no reason to drop BP stocks. as if people in the gulf really give a crap about what BP thinks they should do. although i think BP should solely be responsible for the spill. it wasn't congress that forgot to check the leak because a battery wasn't in place in the well. political backfire isn't what people in the gulf need. im just happy democrats are giving aid instead of placing blame.

Basically what Mr. Barton is saying is that this corporation deserves what American citizens deserve, which is due process. It's about time we realize that a CORPORATION IS NOT A PERSON!!!!!!!!!!!!!!!!!!!!!!! They DO NOT deserve the same rights that people have.

@hollybethtjaden corporations do have rights sir. They have a lot of rights. Due process is afforded to any entity. If you owned a restaurant and someone slipped and fell, is it ok then for the mayor of your town to come down and demand your corporation pay $10,000 to the individual? Or should we go to court first and let justice decide

@wrg2608 Once again, Mr. Obama made a proposal. BP agreed that $20 billion dollars with no cap would suffice. HE MADE A SIMPLE PROPOSAL. BP, as a corporate entity, did what it had to do in order to remain a viable corporate entity. The US Justice Department will proceed with litigation. Hey, Mr. Barton did what he had to do in order to retain his constituency base.

There is a STARK difference between a restaurant slip and fall and an environmental and economical disaster of epidemic proportions. Sometimes the rights of a business must be set to the wayside, to ensure the livelihood and continued survival of multiple communities and the ecosystem. This is just such a case. There is the law, yes...and then there is doing what is actually right. To blindly follow the law is sometimes well more damaging than to usurp it.

Every company deserves justice and due process. Barton stands for that and making liable party pay for damages. Quit being a sheep and unAmerican. What happened was ridiculous and I cant wait until BP renigs on that 20 Billion and waits until the courts decide. This mess is terrible but denying due process is worse than any oil spill.

@ismeme For starters, I'm down here on the gulf coast of Florida. I understand that this mess is huge and a threat to the livelyhood of millions. Our state is hurting already from a lack of tourism. However, I dont condone the strong arming tactics that this administration has played out. This company, whether you like it or not, can do whatever it wants. This whole good hearted "we're going to make this right" song and dance will only last so long. You will wait regardless.

And btw, companies can do whatever they want? Not when they're subsidized by American taxpayers they can't. The Federal gov't is supposed to represent the people. Thank god it's finally taking that responsibility seriously in this case.

@wrg2608 BP is an international corporation. BP is headquartered in Great Britain. International law would be far more forgiving than US domestic law. The international community would initiate a fact finding mission that would not yield results for several years. BP agreed that 20 billion dollars in an escrow account with no cap would suffice. A mutual agreement. No strong arm tactics.

To hell with Mr. Hayward, Mr. Barton and BP. BP is an international corporation that is operating in international waters. Because of deregulation, 11 lives were lost. Many complexities are involved in terms of international litigation. Besides, Mr. Obama made a proposal, he didn't use any strong arm tactics.

oil spill is just one of many pollution issues challenging the
U.S. For example air pollution in urban areas is a
significant cause of pulmonary & cardiovascular disease.
Much of the cost of Medicare for seniors is for therapy
to fight those diseases.There are other examples why we
must take the long-range view.

the U.S. has recently set stricter standards for sulfur
dioxide. The current standards have been in effect for
about 40 years! Various studies have predicted that it
will cost about $1billion nationwide to reach the new
standard & save about $30 billion in health care costs.

care costs than the cost of the pollution control. For

somewhat clean air & water we have today, fighting the
efforts of right wing extremists who focus far too much
on short-term profit, with the result that our air & water are
still too polluted. Over the decades we have seen time &

is the right thing for BP to do for the hurting people of the
northern Gulf coast. Barton's apology to BP, saying that
what the White House did was a shakedown of BP, was
despicable. Barton's action is just the latest example of

You crazy libs aren't seeing it from his perspective because you are starting with a different cognitive basis set. He thinks BP is completely responsible for all damages, but he sees my and your president's actions as extortion. He sees the 20B as a number that Obama gave to BP and said do this or else. There was no due process, it was just Obama telling them what to do- a shakedown. That is how Barton sees it and that is the thing for which he was apologizing.

@ksiarbiter You think Obama said "Do this or else"? LOL BP holds most of the cards here, not the gov't, because BP supplies our military with oil. In 2005 alone, the DoD paid BP $1.5 billion. Why do you think BP have been allowed to brush aside its hundreds of safety citations over the years, lie about the extent of this disaster and call all the shots? There's no extortion; BP agreed to the escrow fund and you can be sure they did it because it benefits them somehow.

BP had the option of not doing the escrow: it'll just be bad PR. Therefore they are not missing any sort of "due process". And there is nothing that shows Obama threaten violence or something illegal to be done if it didn't happen, so how is that extortion?
Barton got his "shakedown" argument from Republican talking points by another organization, an argument which obviously hadn't been well thought out and coordinated, since the rest of the Republicans were quick to condemn him.
