We don't use women and children for shields and we don't use suicide bombers and cowardly tactics like roadside bombs. The difference is that we use precision guided ordinance and do everything we can to prevent collateral damage, while they do everything in their power to kill innocent civilians. That;'s the difference.

Now I think every one of the morons here complaining about the waterboarding of 3 Al Qaeda terrorists would choose having water poured up their noses to being drilled into multiple times before having their heads sawed off.

  • I agree with you, but is that the mark of our society? That we compare ourselves to terrorists, and are better than them, so therefore we are good? I would certainly hope not. The reason why we can call the terrorists abhorrent is because we maintain an undeniable moral high ground. IMHO it should be our goal to maintain that stance specifically so that we never have to debate whether or not our behavior is close to that of our enemies.

  • I happen to agree with you, but my point is larger than that. Rather than saying "well what they do is much worse than waterboarding" I would argue that what they do is torture, and we don't do that...period. Maintaining this clear moral distinction requires absolutes on the issue. When one begins debating the merits and depth of one type of torture vs. another you are blurring the line and establishing ambiguities. I believe thats where America needs to make its stand.

  • It was an accident. There was no criminal act. The order was given to use lethal force only if necessary, and to use flash bangs and non-lethal weapons to help ensure no loss of life. Nobody gave the order to kill children. The ATF used force applicable to the situation. Oh and authorities have admitted to using a technique called waterboarding. That is torture. If you don't believe that then go ask the men of Spanish Inquisition who invented it or the Khmer who borrowed it.

  • This isn't exactly dodging the question. He isn't supposed to have an opinion because it shouldn't matter. As the Attorney General, he is the legal representative of the United States Government. He does not decided if something is constitutional or not, he only prosecutes those who break federal law or infringe on constitutional rights. He doesn't even enforce laws, he just argues for the government's case. So his stance on waterboarding is irrelevent.

  • Okay, I'll do this different way. It's not writing down any where. There is no federal law and no constitutional clause that specifically prohibits waterboarding. A court has to declare it torture first. As a person he has a opinion but at the Atty Gen. he has none. He simply applies the law to cases and cites other cases as precedents. Judges interpret the law. If they declare it torture, he must prosecute whether he thinks it is or not. Tell me, am I being obtuse or did you get it that time?

  • Yukio Asano was also guilty of various other forms of torture including beatings and burnings. The trials following WWII were to make sure no one got away clean.

    During Vietnam, the one soldier in question was brought up on dereliction charges because he disobeyed direct orders NOT to engage in waterboarding.

    The question is not if torture is illegal but if waterboarding is torture. It's not this man's job to decide that. The courts must decide and that decision will be enforced.

    1. Torture is not effective in matters of interogation. Ask ANY expert on the subject.

    2. Torture is not only against US law, it is also against International law. In other words, if WE don't prosecute those in our military who torture, as well as those who order it, they will likely be tried as war criminals at some point.
