This was a continuation of a case, Ashcroft v. Raich that happened a year before. Sort of a second round at the Court.

What iritates me most about Wickard v. Filburn is the law being challenged recognized that a certain amount of the commodity for personal use was not subject to federal regulation under the commerce clause. Subsequent courts have ignored this. The main issue to me in Raich is the outright ban. How does the power to regulate morph into a power to ban?

He doesn't like the people who smoke it. But he also thinks possession of marijuana should be decriminalized.

I've smoked it a few times. It sucks when people say that's so terrible, because alcohol is actually more dangerous.
