He probably could have been taken into custody after the tank became disabled. The thing is the cops really aren't prepared for something like this, and were probably freaked out about it. I don't really like cops, but I can see where they might shoot first, and ask questions later here. It's not like this was one of those situations where they just shot someone over a routine traffic stop. Tankman was out to hurt people, and it's just pure luck that he didn't.
