Even if Nintendo was able to work around the copyright issues (by either paying the royalties or getting Itoi's approval to make the necessary changes) and release the game on Virtual Console in Japan, the fact of the matter remains that Reggie Fils-Aime doesn't think the series would be profitable in the west.
That wouldn't have been a big deal, he's entitled to his opinion, but he made things personal by basically saying that Mother fans don't matter.

No , actually , they're not. Smiles and Tears is the ending credits song from EarthBound. Eight Melodies is the song from EarthBound Zero (Take a melody , simple as can be , blah blah). What would be the "eight melodies" of Mother 2 has no official name (I think it is because the game's soundtrack was never released entirely , and when the fanbase needed names they just invented the names of the songs , that's why japanese pokey means business has another name).
Apart from that , most people refer to Mother 2's "Eight Melodies" simply as Smiles and Tears to avoid confusion with EarthBound Zero's Eight Melodies.
