  • OMG WRONG WRONG WRONG!! You DO NOT need to put a disclaimer ANYWHERE unless you HAVE been paid to review the product OR if the product was sent to you!! If you have purchased your products with your own money and are reviewing them for "fun" then you are absolutely not obligated to mention anything about the FTC ANYWHERE!!! On the other hand, if you are a vlogger who does reecieve products to review from companies/paid by, then you must put a disclaimer! EASY AS THAT!

  • I've been advised to disclose no matter what. There are too many people on YouTube who falsely flag who would love to falsely report. Disclosure covers your own butt.

  • That's a hard one. The FTC says that if your videos and blog posts are viewable in the US that it applies to you. The Canadian Federal Government and the CBC both say that no matter what the FTC says that the guidelines don't apply to Canadians. The FTC still says it does apply to Canadians. I'm still going to disclose because I'd rather be safe that sorry. I'd suggest you check with your own federal government to see what they say.

  • This new guideline system is RIDICULOUS. For every video, every brand? I think that's an added on feature to possibly collect 11k from unsuspecting people. Why 11k? Hm... If you are doing a review I think it's ok but you shouldn't have to say if they paid you or not. That seems personal to me and if someone got paid even a dollar it could give people an entirely wrong message of the persons POV and ruin the video. At this point I have no argument signing a petition against parts of this rule.

    Not everyone can 100% remember everything that they need to in a video to protect themselves.

  • For me, i am just going to say i am using a red polish or a black eyeshadow. I am not going to list any product at all and will cover them up when i go to do a tutorial so that way the name doesn't show. Now if i go to do a review then i will list a disclaimer.. this is just ridiculous !!! I see a lot of typing for some peeps !!! Take Care Cat and have a Merry Christmas & Happy New Year !

  • Thanks! Your idea would definitely work. I just made a template that I can cut and paste into the sidebar.  I just insert the company names after I insert it. That way it's not much work at all.

  • I know what we should do!!! In strike, all of the bloggers and vloggers should do this. Make ironic makeup videos where we say "Now I will use an eyeshadow!" don't even show the eyeshadow, say the color, brand, etc. At the end say that it was irony, but it'll raise people awareness about how ridiculous this is.

  • It would be a heck of a lot more work to get all of the makeup bloggers and vloggers together for that sort of thing than it is to add a little bit of information to the sidebar. Good idea though.

  • I just answered your PM, but didn't realize you were planning on showing a picture of the jacket. I would just put "I don't own this jacket but would like to. I have no affiliation with the company, and am not receiving any financial compensation from the company for mentioning their product in my video. "

  • The FTC things in their sidebars are disclosures.

  • So if your video was a month old and you didnt put it in the sidebar you dont have to go back and change it?? Every time you used a product? Even if you bought it yourself at Wallmart??

  • It only applies to videos made December 1st or after - you don't need to worry about older videos. The risk of being falsely reported on YouTube is so high that it's safer to just disclose everything.

  • why not just put a generic blanket disclaimer on all videos saying "everything in this video was paid for by an evil corporation, happy now FTC??".

    whether it's true or not, it covers everything.

  • I do blogs and i find this absolutely ridiculous. I have never even wondered about people who have purchased products or whether they were promoting via youtube or through my blogs. This is actually the first time I've heard about this, and I'm glad I did because I'm working on a blog now. I can't believe that we are living in a society that has to know every move we make anymore. I think we have to stop and ask ourselves this: How free are we?

  • I was advised to put it in my sidebar, but yes, you could just say that. If your friend doesn't own or work for the companies she's giving you the samples from, they would be considered gifts and would be exempt from the guidelines.

But who the hell's business is that? If I am getting paid for it, that is my PRIVATE PERSONAL MATTER. Having someone give a biased opinion about a product you made is a terrific marketing strategy.

  • I agree. Whether or not a product was free, most of us still give honest reviews and don't use it or review it if we don't like it. Gifts and prizes are exempt from the guidelines.

    Do these guidelines also apply to software? If so then I should have already been fined $11k since one video uses some video from a copyrighted game.

  • The FTC says their guidelines apply to anyone who's content is viewable in the US. However, the Canadian Federal Government says that no matter what the FTC says it will not apply to Canadians. I would suggest contacting your own Federal Government to find out how they apply to you.

    If you create a product and sell it and make a video about it, you would probably need to disclose that you are the owner of the company.

  • Your copyrighted game would fall under copyright laws. It could also possibly fall under the FTC guidelines as well if they interpreted your video as an endorsement for the game.

  • Let's say that a company made a really good product back in the 70s, but then they go out of buisness and no larger company buys them. So they go out and do not exist anymore. Do you still have to disclose stuff?

  • That is a very specific question that would need to ask the FTC. The guidelines deal mainly with brand names and endorsements so I don't think stories or pictures would apply. Again though, you'd have to check with them to be sure.

  • It's actually not scary at all. It's just a matter of adding some information to the sidebar. We'll all adjust to it over time.

  • No, it's any time you endorse a product. When we do makeup tutorials any time we say a brand name and use a product it can be considered an endorsement.

  • You don't make videos and clearly have no idea how predominant false reporting will be on YouTube. Many of us get false flagged and one star dinged everyday, people go out of their way to dismantle guru's reputations, some people have even created blogs to publicize their hate for some gurus - False reporting can and will happen. It just gives the haters one more thing to use against us.

  • Wow I had no idea this law went into effect. I had to find out by someone commenting on my video saying I needed to put the disclaimer. This is so annoying because I'm not a very popular guru so why would I get anything for free? I think the FTC laws are ridiculous and should only apply to people with a certain number of subscribers. But then again that wouldn't be fair so idk. Thanks for doing this video though it really helped clear things up for me.

  • Does it apply for UK? as the FTC is for 'American consumers'? Also you dont need to post a disclaimer for every product, ONLY for the products you ARE being endorsed for/received for free.

    So it may not be such a hastle, i think it'll be quite helpful as most people dont reveal when theyre products were free.

    Most everybody I know on here already discloses when they get things for free to review. The only thing that's different from what we normally do is disclosing for tutorials as well as reviews.

  • Additionally, because the guidelines are so vague and open to interpretation and because the risk of being falsely reported on YouTube is so high, I was advised to disclose everything whether I paid for it or not. It just completely covers you so that if someone makes a false report, any investigation stops as fast as it starts because you've disclosed everything. I am hoping the FTC will recognize the problems with their guidelines and change them accordingly.

Also, when a consumer reads a reviewing they're choosing that review and that reviewer, no-one is forcing them to give any weight to that review when making their choice, why should they then have any legal footing to turn round and sue someone who was trying to carry out a good service. these guidelines have made me angry.   • Exactly. Reviews should really be taken with a grain of salt - because a product that might be amazing for one person might not be for someone else. For example - LashBlast mascara - a lot of girls love it - I cannot stand the stuff. People need to look around and see different reviews and not put all of their faith in one review - different people have different opinions.

  • How long d'u think it'll be before someone challenges this as an infringement of freedom of speech "you can only say what you want if you say this first". And does anyone else see this as an invasion of privacy stating how much you spend?And how strong does the affiliation need to be? In the u.k. judges have been barred from hearing cases involving banks their wives have accounts with.

  • Most of us have always disclosed for reviews - but I do agree with you - when it comes to tutorials etc, it is an invasion of privacy to some degree. I also agree - an affiliation is an affiliation regardless of how small that is. I believe the guidelines were left so vague and open to interpretation for a reason - so they can keep changing the rules as they go along. They should have made sure they had everything ironed out before they went forward with the guidelines.

  • Being a web developer myself, I've had to deal with similar things with putting up terms of use and privacy statements. So this is just another one of those types of things. Seriously, I think once they try to enforce this they'll be revising things as they'll find the problems with this.

  • Exactly. I think over time they will see that the guidelines are way out there and will start revising them to make them easier for them to regulate and monitor. It's one of those things that will just take time. Once the FTC recognizes the problems with it, they will hopefully change things to iron out the problems.

    to me saying sent is misleading because people will still think you ordered it, payed for it and were sent it.

  • Most people know when you say that a company sent you something that you got it for free. I believe you do have to use the word free to satisfy the guidelines, but I don't work for the FTC so you'd have to check with them on that one to be safe.

  • So the best way to avoid a possible fine is to not mention the brand of the product. Excellent, unless I'm being paid for it then, from now on, no mention of any products. Let the merchants and manufactures fend for them selves and leave us out of it unless they are willing to pay us.

  • I'll believe it when the feds come knocking on my door. a friend of mine did some research on the FTC website. these are just guidelines, not laws. if you paid for the product you don't have to put a disclaimer. the only time you do is if the company provided it to you to do a review on it. these facts can be found on the FTC website.

  • Sorry hun, your friend is going on his interpretation. My lawyer read the guidelines over and contacted the FTC several times before I even posted this video. The guidelines are very vague and open to interpretation, and given the high risk of being falsely reported, it's best to disclose everything. If you had watched my video, read the sidebar, and read the annotations you would realize that.

  • Ok, I stopped 15 seconds through this video...

    Copy right is very hard to prove, and a company could sue anyone wearing a peice of clothing with that companies logo on it, if they did, it would be imposible. That would be alot of people. Not only that, it's very hard to find those individuals. I could make a video of one of my stereos and just have it play music and they couldn't do anything.

I could have a video of nothing but things with brand names in them and not get anny trouble 'cuase I payed for it or got it for free or what ever. If it was given to you by the co. that made the product and they want you to make an iterview for them via YouTube and not metion that compainy then you could get some heat. Good day.

  • Thank you for your interpretation. As my lawyer stated after reading the guidelines and contacting the FTC on several occasions, these guidelines are very vague and open to interpretation.   • I just removed some comments that came from people who were trying to get their friend some free views. One of those people chose to make a derogatory and disgusting video directed at me, so I ended their ability to advertise their friends channel in these comments.

  • One of the reasons this is happening is because of websites & fictitious blogs being propagated by organizations such as the Calorie Control Council. In that case the CCC propagates fake characters promoting how safe aspartame is. While it affects us all in a ludicrous way, this is needed to stop the spreading of lies for profit that affect health of the world. There are more things going on in this society than most care to understand. Thank You for posting this video.

  • It's not YouTube - it's the FTC and it applies to all social media. The FTC fulfilled their obligation by making the guidelines public 2 months ago.

    it's definitely going to be harder for these bloggers to post all the products and for viewers to get the information to get the looks.

  • I don't really think the makeup scene on YouTube will go down that much. For those of us who continue to stay brand names it's just a matter of adding information to the sidebar. But really, people are so concerned about having the same exact colors we are using - I think people could learn a lot from seeing a color and trying to match it and mixing colors they may have to come with that color.

  • I was advised that because the risk of being falsely reported on YouTube is so high, that it was best to disclose everything so that there would be no question about what I did and did not pay for. If you don't' disclose things you pay for, and then somebody decides they think they you got it for free and didn't disclose and reports you, the FTC would have to follow up on the report. If the info is already in your sidebar, the investigation doesn't even start.

    What if you are wearing, say, a t-shirt, or a hoody, in a video - eg. A band t-shirt, or a t-shirt with a brand name on it. Does that mean if you can see it, you have to put a disclaimer? Thanks, please get back to me.

  • This is insane. The FTC says they have good intentions,and sure, I'll give them that. But I think it should be up to consumers to be cautious of what they find on the internet as well. No matter what, you can't rely on one person's opinion, whether they're given the product free or whether they bought it themselves.

I would suggest you contact your Federal Government and see what their stand on this issue is.

  • The FTC says you do, but both the Canadian Federal Government and the Canadian Broadcasting System say you don't. I would say to follow your own government, however, that being said, I am still putting in disclosures anyway to protect my own butt. Canada plans on making their own laws regarding this soon anyway.

  • I can totally understand it for reviews - most of us have always done that in our reviews... for every video I think it's a bit ridiculous though.

  • Does the same go to recording bands at concerts? Do we have to put a disclaimer that the band isnt paying us to record them? Lol or what about if we wear a band shirt? Dang this stuff is crazy!!

  • Recording bands falls under copyright laws and is completely different.

    But i am going to post a disclimer from now on! One disclaimer for everything i did by myself from a compeny i have no affiliation with, and aren't gonna be paid for showing / reviewing or using - and then for the few things that is an exeption.

  • I really hope no one is paying attention to this sensationalist rubbish! Has anyone read the guidelines? I have, and they do not require that you put a disclaimer on videos when you mention a product when you were not compensated in order to "protect" yourself from false claims. Also check out the official FTC Guidelines video on You-tube. Most You-tube reviewers do mention when they have received a product from a company to try out and they have always been in compliance.

  • Are they trying to imply that Americans are easily driven to consumerism? Since when has a capitalist nation wanted to put laws against false advertising? Hypocrisy much? These are sarcastic questions, however, the new regulation is laughable...

    And are they really going to hunt down every single person who lies? Cause that's totally not what happened during the old napster days when 1 out of every gazillion people were sued for piracy.

  • I don't think they are going to actively seek people out - I think they are going to wait for reports and complaints to come in and then investigate the reported.

  • I agree that it's a good thing for reviews - but not much is really going to change anyway - most people have always been very honest when doing reviews. I just think it's a pain that we have to do it in every video we mention a brand name in, but we'll get used to it...no biggie...
