His order was not lawful, in a number of reasons... the fact that he claimed it was private property was false, the fact that he issued an order that went against their 1st amendment rights to free assembly make his order "unlawful". This "private property" public space was most likely a proffer the developer had to make to the city in order to get the building permit. While the developer probably has to maintain it, the city is the entity that is SELECTIVELY enforcing NON-EXISTENT laws, and hiding behind the building's owners to do so.
