I love the misunderstanding of Open to public vs Public space. Just because a company opens it's doors ot the public, that being you can come in use the restrooms, the lobby to rest or other things that are not considered loitering or harassing the company with out having specifiably doing business there.

Public space is a city park, the streets and things are are owned by the government. they can be open forums for the 1st amendment.

This "private property" public space was most likely a proffer the developer had to make to the city in order to get the building permit. While the developer probably has to maintain it, the city is the entity that is SELECTIVELY enforcing NON-EXISTENT laws, and hiding behind the building's owners to do so.
