Yea, then what happens next, after you refuse consent to search??? you just stand there like a fuckin idiot....? They bring the dogs and find it anyway?? then what?
however, you mostly don't consent if you have something to hide... or porno you donn't want them to find. Not consenting is pretty much proof enough you're hiding something.
@darkfire8008 I disagree, I am a very private person and do not particularly enjoy police or anyone else looking at or disrespecting my things or religious items. They judge you and I do not feel I should have to defend my lifestyle and beliefs. Why are cops allowed to lie, ask trick & double questions etc as a form of entrapment? Why if I am stopped for a traffic violation do cops ask where I am going and where I am coming from? Why are they allowed to ask if I have anything illegal in my car? Why do they want to search my car? I don't fall for any of this BS by the way. I just resent being asked their retarded questions. Standard response: Either warn me or write me. That choice is yours. I usually get the ticket & the 3rd degree ends
This caption is utterly stupid. The police are not allowed to search my car, unless I stupidly grant them permission. There is no one on the face of the earth other than me with "authority" to do anything to me or my property without my explicitly permission. Were it otherwise, I could not profess self ownership. Rather, I would be owned--lock,stock and barrel--by the person or persons who professed some mystical authority to do with me as they will.
@YODAWGWHATSUP321: The officers probably already had a reasonable suspicion that your friend was in violation of the law, in which case they can search even if he refused consent.
So they probable asked for consent, were denied, then called in a dog to develop probable cause to search. Your admission that 'they of course found it' adds credibility to this scenario.
Your friends refusal will help his chances of being exonerated in court, should he chose to fight it.
@YODAWGWHATSUP321 If your friend recently smoked weed in the car (and I am not saying he did) right there is "probable cause" for the dog to be called in. I have seen cases where a stash is under the seat, 3-4 guys smoking, driver is speeding, with a tail light out on the car. I don't want to sound judgemental;..but anything even close to this situation is stupid. They deserve to get caught!
@YODAWGWHATSUP321 If they detained him, even for 1 extra minute, to wait for the dogs to arrive, before having probable cause to detain him, then I would think in most states the search was NOT legal.
@DarkNation58 The question is, what happens if you don't and they find nothing illegal?
It's a breach of the 4th amendment and you can sue the department for unwarranted searches, just because of a "probable cause" while you did not consent to a police search and still searched without finding anything.
This video is correct HOWEVER the cops will lie and ur still screwed then u got na/aa classes...po officers to see/cost alot inless u just say f it an do the jail time 1 out of 10 will make it in rehab as far as illegal car search they can add up to 5-10 extra charges and then they will cut deals with you sometimes no deal is can take u broke or put u in a different class
I got pulled over and the officer pulled that 2 question shit about me having drugs and if i mind him looking in my car so i said " no , sir i have nothing illegal in the car, and i know i can refuse you searching my car so please get out of my car" and this prick gave me a ticket and got a search warrant because "i was acting suspicious" what the hell is wrong with cops these days...
Easiest way to store contraband if you HAVE to travel with it is a locked case in the trunk. Try not to have a hatchback so it is also outside of your domain of influence.
I would consent to any search requests because my car does not contain any specs of drugs. So...I like to waste the police's time whenever they feel like consenting to do so.
Hey I swallowed My Crack and Coughed it back up while he was searching the car, then swallowed it again. I thought I was gonna Shit Myself But he did let me go
More dangerous than the 75 dollar seatbelt ticket is the attorney fees it takes to clear the mess up that could be avoided. Remember, the more societal db's that cop creates, less competition for booty!!!

No, I literally have nothing to lose by consenting to a search because I don't do or carry drugs in my car....? Was this channel made specifically for druggies lol?
So you agree with just bending over then ? Because while this may be leaning towards the premise that one IS in fact doing something wrong, I've personally dealt with this while NOT doing ANYTHING wrong and by your statement, you seem to suggest it fine for an officer to just decide at random ( and yes, it happens ) to pull someone over ( maybe shady-looking / maybe not ) and search their property and we should all be fine with that, which I for one am not in the least bit .
@jcboogiebear Not at all. You say you've dealt with this but are they really taking a huge liberty by wasting 10 minutes of your day to ensure you aren't carrying a controlled substance? Don't get me wrong, I dont think small time drug users are a huge issue, if you want to smoke weed fine by me! But, we all pay taxes for the police to make our country safer, if that means 10 minutes out of my day then i'm fine with that - it's called taking one for the team. They use reasonable suspicion.
this is pretty pointless, unless your trying to hide something if your clean, and the cop thinks you up to something, make him look stupid and let him search, and see himself that your clean
@Stevie9026 its not pointless, if that cop is dirty, he can plant drugs and haul your ass to jail, innocent or not, but if you refuse to allow him to search your vehicle, unless he has probable cause, he cant do the search, if he has to ask in the first place, then he probably DOES NOT have probable cause, privacy is privacy, you have everything to lose if you dont exercise your rights!!!
what about if you have an acient drug use pass, they dont let you shut the door, bring the drug dog and just 'claim' that the dog hit on an odor, can that be brought up in a video to show its bullshit?
i find it hard to believe ive never used or transported drugs in a car ive owned since 2006, and every time i get pulled over the drug dogs come in and 'hit' on an odor, real reason being, they leave the door open and dog invites himself in, i dont know the signal for a smell hit.
@ovoxox no keep it in a glove box (or as when i was pulled over with x4 bags of weed scales many joints and roaches) i closed my ash tray right way and my closeable cup holders held my pipe papers and weed i was smoking. i also kept everyting in my back pack and my car very clean... be kind and assert your rights.
well this would have been great b4 i got arrested. cops forced there way into my truck and got evidence agenst me and i told them i didnt want them to search. so they arrested me and searched anyways.
@garciajennifer223 My friend was pulled over last weekend by a state trooper, he smokes cigarettes and had just gotten the car detailed. According to the officer he smelt weed (cig smoke & air freshner i guess), so ordered my friend out and conducted a search to find mj. My friend knew there wasn't weed in the car (because he doesn't smoke and he didn't know he could stop the officer). The cop tore apart his car while my friend stood outside. Was he breaking the law/illegal? No.
@garciajennifer223 Great idea! Let's all be completely submissive to authority and give away our rights because it's easier than standing up to a police officer and telling him when he's out of line. I don't want some asshole stranger on a power trip rummaging through my stuff. Would you be ok if the authorities coming to your house to perform illegal searches? Would it be less worrisome if the authorities tracked your every move? Where do you draw the line then?
@MerritRenewing You misunderstand me. I'm not saying that we should give up our rights at all. I'm simply saying, that IF a policeman should ask to search my car, they wouldn't find anything. They also wouldn't see anything that would give them probable cause. IF they still decided to search my car, I would get to sit back and watch them and know they are wasting their time and making idiots of themselves, bc there would be NOTHING in there. I'm not saying I would just consent to everything.
probable cause can be something as simple as stopping to long at stop sign. or going 1 mph over the speed limit. basically, probable cause will always screw you over.
safest bet is to buy a lockable container and keep anything illegal in there, the Constitution protects that locked container as long as it remains locked. this could be a glove box, or even the trunk of your car as long it is actually locked. and you can conceal the key from them too. the are not allowed to take it from you.
@vanarcken113: Officers would be hard pressed to use your examples as probable cause to search though.
For example, exactly what would they list as the "the persons or things to be seized" as evidence that a person stopped to long at a stop sign, or speed one MPH over the speed limit?
its better to let them search or else the problem will get bigger u will be there for hours and the police officer will get his search warrent ive seen it happen many times and he will find any problem to keep u there longer or give u a ticket
remember this is their job they get paid to do this they have nothing else to do
@mindmagition: Some people are not as quick to give up their rights as you seem to be.
Officers are not allowed to detain for 'hours' without reasonalbe suspicion, probable cause or consent. Usually when you see 'it happen many times' it's because the person being detained has given consent without realizing it. For example, many people think that when an officer asks you to stay while he waits for a K-9 that they have to stay. Many times, they are free to leave but don't realize it.
@BomxStudios No, but he is telling people how to tick off an officer and make a situation much, MUCH worse. This lawyer has no clue how officers in the US operate. Its hilarious.
If you consent to a search, then you probably will be searched.
If you refuse to consent to a search, then you probably won't get searched.
They are lying if they say they can keep you forever while they get a dog. Courts have generally allowed about 20 minutes or so, or what it usually takes to write a ticket, before they must release you, or arrest you.
I have personally heard the resignation in a LEO's voice when dispatch tells them a K9 is not available.
@Pafoofnik1 well they actually did that to my friend they made him wait cuz the officers city that pulled him over didnt have dogs so they had to wait for another township to arrive with ther k9
@Pafoofnik1 hes reason of suspicion was his eyes were red and he looked high and he didnt want the cop to search him so he held him till the k9 came but he didnt find anythign but he gave him a ticket for a loud stereo
@UFGators89: Police think they are allowed to lie. It's hard for them to justify making a person wait when they have to acknowledge that you are being detained to wait for a dog... and know it's being recorded...
But you've admitted that there was more to the detainment than just the refusal, weak though it is...
@freakylionkisser me too bro a half eight of some grape ape....stem and all chp was cool tho no dl and it reeked like purp and they just had me park my car on the road and walk home
@150rrider13 If he smells something then that's just a hunch. It does not give him the right to force himself into a situation where he can overthrow his power over you without you even knowing about it.
@Hookajr1 I was just thinking the same thing. Cops always search and charge people without having probable cause here in NY. They have no respect for civil rights.
@dearpsychonaut Can they really flag your car to be pulled over later. That sounds like it should be illegal. Would that go through the police computer? could you let me know that sounds interesting.
I'll be at your house tomorrow to preform my surprise search of your car, house, and asshole. If you have nothing to hide then there shouldn't be a problem.
This isn't about breaking the law. It's about freedom and the right to privacy. Btw, while I'm at your house I'll go ahead and install video cameras, microphones, and tap all you phone lines to make sure you don't break the law.
remember, when our system breaks down, people like the military & police are gonna do the easy thing & follow orders...they'll be the enemy of those of us who revolt...motherfuckers!!! i want my ice cream in a cone, & I'LL decide if it's chocolate or vanilla...MOTHERFUCKERS!!!
i notice when cops exit u from a vehicle, they usually make u sit or stand away from the car. u can't watch them search, so they can plant anything they want, right? i wonder if the do that? cops in texas are all dickheads about a month after they leave their academies...revolution!!!
fuckkk the police are dick and will use your denial of a search as probable cause, if you refuse a breathalizer test even if there is no evidence you are drunk they will arrest you.
The court has upheld that an officer can search for a driver's license on a traffic stop, if he believes you are avoiding presenting it. They can open doors with tinted windows (officer safety issue). If your vehicle is towed, most departments require that they conduct an inventory of property within the vehicle.
when is a cop actually gonna back down if you say you do not consent??? Me and my bro were hanging around downtown by our public pool, and a cop thought we looked suspicious (we wore black and had long hair ) so he searched us and one our smart friends said "officer i do not consent to a search" and he searched him anyways but found nothing...and he arrested him for nothing..ik that this is the law but when is a single cop in a smallish town gonna actually follow this.
What if it's something like "Well judge, I got the faint whiff of pot smoke"
Impossible to prove, he might have smelled pot, he might not. He may have just imagined it.

Probable cause = Your Black smh
flipitapa 5 months ago
probable cause can be something as simple as stopping to long at stop sign. or going 1 mph over the speed limit. basically, probable cause will always screw you over.
safest bet is to buy a lockable container and keep anything illegal in there, the Constitution protects that locked container as long as it remains locked. this could be a glove box, or even the trunk of your car as long it is actually locked. and you can conceal the key from them too. the are not allowed to take it from you.
vanarcken113 5 months ago
@vanarcken113: Officers would be hard pressed to use your examples as probable cause to search though.
For example, exactly what would they list as the "the persons or things to be seized" as evidence that a person stopped to long at a stop sign, or speed one MPH over the speed limit?
The rest of your comment is spot on.
Pafoofnik1 5 months ago
its better to let them search or else the problem will get bigger u will be there for hours and the police officer will get his search warrent ive seen it happen many times and he will find any problem to keep u there longer or give u a ticket
remember this is their job they get paid to do this they have nothing else to do
mindmagition 5 months ago
@mindmagition: Some people are not as quick to give up their rights as you seem to be.
Officers are not allowed to detain for 'hours' without reasonalbe suspicion, probable cause or consent. Usually when you see 'it happen many times' it's because the person being detained has given consent without realizing it. For example, many people think that when an officer asks you to stay while he waits for a K-9 that they have to stay. Many times, they are free to leave but don't realize it.

The cops never have probable cause.
They pull you over for speeding, it's a non criminal offense. They will still demand to search your car.
Next, they will insist they are allowed to search it if their policy is to tow your car.
First, a policy is not law, they are illegally towing your car since due process has not occurred and no written order of seizure provided.
This is just a ploy to take a written inventory of your car the cop will have you sign. You sign it, you gave him permission.

@BomxStudios No, but he is telling people how to tick off an officer and make a situation much, MUCH worse. This lawyer has no clue how officers in the US operate. Its hilarious.

its a losing situation if you deny them to search it make su look suspicious and they will just bring the dogs
UFGators89 5 months ago
@UFGators89:
Pafoofnik1 5 months ago
@Pafoofnik1 well they actually did that to my friend they made him wait cuz the officers city that pulled him over didnt have dogs so they had to wait for another township to arrive with ther k9
UFGators89 5 months ago
@UFGators89: Did your friend repeatably ask if he was being detained? Did he repeatably asked if he was free to leave? Did he record the encounter?
If not, then the officer could make the argument that your friend consented to wait... I've seen that happen as well.
So my original comment is still valid.
Pafoofnik1 5 months ago
@Pafoofnik1 hes reason of suspicion was his eyes were red and he looked high and he didnt want the cop to search him so he held him till the k9 came but he didnt find anythign but he gave him a ticket for a loud stereo
UFGators89 5 months ago
@UFGators89: Police think they are allowed to lie. It's hard for them to justify making a person wait when they have to acknowledge that you are being detained to wait for a dog... and know it's being recorded...
But you've admitted that there was more to the detainment than just the refusal, weak though it is...

if the officer smells marijuana in the car, is that enough "tangible" evidence to search the vehicle?
150rrider13 7 months ago
@150rrider13 If he smells something then that's just a hunch. It does not give him the right to force himself into a situation where he can overthrow his power over you without you even knowing about it.

This isn't about breaking the law. It's about freedom and the right to privacy. Btw, while I'm at your house I'll go ahead and install video cameras, microphones, and tap all you phone lines to make sure you don't break the law.

MrAnthony78666 8 months ago
This works on paper but most police are power mad/ crazy and do what they want When they want.

Brett4301 10 months ago
