Why are they allowed to ask if I have anything illegal in my car? Why do they want to search my car? I don't fall for any of this BS by the way. I just resent being asked their retarded questions.     So they probable asked for consent, were denied, then called in a dog to develop probable cause to search. Your admission that 'they of course found it' adds credibility to this scenario.

    Your friends refusal will help his chances of being exonerated in court, should he chose to fight it.

I have seen cases where a stash is under the seat, 3-4 guys smoking, driver is speeding, with a tail light out on the car. I don't want to sound judgemental;..but anything even close to this situation is stupid. They deserve to get caught!

    It's a breach of the 4th amendment and you can sue the department for unwarranted searches, just because of a "probable cause" while you did not consent to a police search and still searched without finding anything.

  • Easiest way to store contraband if you HAVE to travel with it is a locked case in the trunk. Try not to have a hatchback so it is also outside of your domain of influence.

    i find it hard to believe ive never used or transported drugs in a car ive owned since 2006, and every time i get pulled over the drug dogs come in and 'hit' on an odor, real reason being, they leave the door open and dog invites himself in, i dont know the signal for a smell hit.

According to the officer he smelt weed (cig smoke & air freshner i guess), so ordered my friend out and conducted a search to find mj. My friend knew there wasn't weed in the car (because he doesn't smoke and he didn't know he could stop the officer). The cop tore apart his car while my friend stood outside. Was he breaking the law/illegal? No.

They also wouldn't see anything that would give them probable cause.   • probable cause can be something as simple as stopping to long at stop sign. or going 1 mph over the speed limit. basically, probable cause will always screw you over.

    safest bet is to buy a lockable container and keep anything illegal in there, the Constitution protects that locked container as long as it remains locked. this could be a glove box, or even the trunk of your car as long it is actually locked. and you can conceal the key from them too. the are not allowed to take it from you.

    For example, exactly what would they list as the "the persons or things to be seized" as evidence that a person stopped to long at a stop sign, or speed one MPH over the speed limit?

    Officers are not allowed to detain for 'hours' without reasonalbe suspicion, probable cause or consent. Usually when you see 'it happen many times' it's because the person being detained has given consent without realizing it. For example, many people think that when an officer asks you to stay while he waits for a K-9 that they have to stay. Many times, they are free to leave but don't realize it.

    They pull you over for speeding, it's a non criminal offense. They will still demand to search your car.

    Next, they will insist they are allowed to search it if their policy is to tow your car.

    First, a policy is not law, they are illegally towing your car since due process has not occurred and no written order of seizure provided.

    This is just a ploy to take a written inventory of your car the cop will have you sign. You sign it, you gave him permission.

    They are lying if they say they can keep you forever while they get a dog. Courts have generally allowed about 20 minutes or so, or what it usually takes to write a ticket, before they must release you, or arrest you.

    I have personally heard the resignation in a LEO's voice when dispatch tells them a K9 is not available.

  • @UFGators89: Did your friend repeatably ask if he was being detained? Did he repeatably asked if he was free to leave? Did he record the encounter?

    If not, then the officer could make the argument that your friend consented to wait... I've seen that happen as well.

  • The court has upheld that an officer can search for a driver's license on a traffic stop, if he believes you are avoiding presenting it. They can open doors with tinted windows (officer safety issue). If your vehicle is towed, most departments require that they conduct an inventory of property within the vehicle.
