No, you've completely missed the significance of the entirety of the past 6 1/2 years of Bush-Cheney. Nearly everyone in this administration is failing to live up to the oath they took to protect and uphold The Constitution. Their common excuses have been confused statements about protecting and upholding the President's personal wishes, which is a distortion of the oath.
