As far as the arrest goes, the arrestee was being charge with an offense. Under Canadian law, a person is required to identify him/herself when he/she is being charged with an offense. i can understand that he wants to dispute the offense, but by refusing to identify yourself, you are garenteeing a ride to jail. In canada, you are considered innocent until proven guilty beyond a reasonable doubt. You are garenteed your day in court. Dispute the charge in court.

If you go to the other vid of him just being arrested, it explains in the description that the case was dismissed the next day, and that legal action is being taken against this person acting like a cop. It's principle friend, nothing else. We have a charter of rights and freedoms for a reason. Peace officers like this need to be reminded of that, before we lose those rights for good.

You said a person has to identify themselves when being charged with an offense, how can I answer to a charge when I do not even know the nature or the cause of action to come to the conclusion that an offense has occured and charged in consequence nor do I know WHO is being charged? As far as the arrest goes, the arrestee was being charge with an offense. Under Canadian law, a person is required to identify him/herself when he/she is being charged with an offense. i can understand that he wants to dispute the offense, but by refusing to identify yourself, you are garenteeing a ride to jail. In canada, you are considered innocent until proven guilty beyond a reasonable doubt. You are garenteed your day in court. Dispute the charge in court.

If you go to the other vid of him just being arrested, it explains in the description that the case was dismissed the next day, and that legal action is being taken against this person acting like a cop. As far as not knowing something about the charge, that is the officers job to explain to the arrestee. Now not knowing the law is a reasonable defense in some cases. Now, this arrest was false. I don't automatically try to get away; most officers are wonderful people. But if I get talked to an officer that accuses me of doing wrong, I ask him if he's detaining me (which has happened to me). If he says he is, then I'll stay. But if he doesn't say or says no, then he has no right to keep me there and I can leave freely without any trouble.

You don't have the right if you're being lawfully detained. But, a requisite of a lawful detention is reasonable suspicion. If a Police Officer has not fulfilled the requirement of reasonable suspicion, then the detention is not a lawful one - and, you absolutely never under any legal obligation to comply with any unlawful order.

@ih8faggots10000 I realize that, BUT IN SOME STATES, Unless the cop says he's detaining you, You DO have the right to walk away. It's not the wisest thing to do, but you have it and until he legally detains you, he can't stop you.

@ac3268 Did you? I don't have to see anything, but the common law to know that the due process should have been enacted but the cop doesn't want to be lawful he wants to be a power tripping jerk. None of us was there, so under the common law a sovereign has a right to travel (no criminal offense). If anything, the alleged charges are a misdemeanor & the cop should behaved lawful & issued a ticket which CAN be refused. No felony, so why the unlawful detainment & arrest?
