I love the term "lawsuit abuse" ...according to the American Bar Association over 80% of people who are legitimate VICTIMS of medical malpractice never file a suit.
However what IS true is that 1 of every 3 dollars goes to pay administrative expenses (such as Doctors chasing the insurance companies for money). AND... 30% of all tests and procedures are unnecessary (but Doctors and health care facilities make money doing them, so they do).

Unfortunately, contrary to conventional wisdom a complete deregulated Health Care sector will inflate rapidly. The health care sector behaves different to standard commodities. There is a reason why Japan, Canada, Germany, France, S Korea, Taiwan, Australia ended up having a Government controlled HC Sector.
In the US the history of HC has been from completely deregulated to increasing regulations as needed. Now we are coming to the realization that is not working and needs serious reform.

If you do not have insurance, as 30 Million do not, you do not get care. THAT is rationing.
If you have a pre-existing condition, you cannot get insurance, and must pay out of pocket. If you cannot afford to pay, you do not get care. THAT is rationing.
If the procedure your doctor recommends is not covered by your insurance, you cannot get the care. THAT is rationing.

The healthcare reform bill isn't focusing on insurance, which you JUST DID. Read the bill, please, and stop pushing someone else's agenda or fighting some invisible evil agenda you think is going on.
What you're describing, for private insurance, people already try that. Pay more for better insurance? That ignores the point of the bill
