This is nonsensical. This is perfect example of not looking at the intent of the law. I don't believe the law was intented to be use in situation such as his. They were married, plain and simple--no crime. A husband or wife have the right to look at the others information (e.g.) because the information belongs to both of them--hence when you marry, you become one. If she did not want him to read her e-mail she should never have left her password around.

Did you know adultery is a crine? At least it is in NY. And husband or not, that is YOUR email. Married or not, the law says that you're not supposed to check anyone else's mail. Marriage doesn't change that. Now from a moral standpoint, yes.
