You would think they would only count as 1 star, but no, if one more person leaves a low star they count as 5 plus the 1 that the other person left. You would need 600 good stars in the period to not be suspended. 1 asshole buyer out of 100's is all it takes.

I think your analogy from a legal standpoint is slightly flawed...if you went to Coles and then wrote a cheque you knew would bounce, THAT is what the buyers are doing who click "payment sent", because it is deliberately misleading the seller that the payment is forthcoming. Although again that is flawed too because there's no intermediary at Coles, no advertising medium (eBay) who will deny a refund on fees of the buyer doesn't pay and you win the dispute.

Ebay finally refunded part of my payment and closed the account since he did this to a few bidders. Turns out it he was using his bosses account on his off times.
I have to say that I'm so happy that you got ripped off by some of the jerk-off sellers on ebay. Now maybe you can finally understand why we honest buyers will only pay with Paypal. We know they'll back us up against these scumbag sellers. Not all sellers are as honest as you Joe and at the same time not all buyers are out to scam you.
For the seller, contact the seller, and see what he will do for you. If you are pleased with the way he resolves your problem, don't leave any feedback. If he does not respond, open a case, get your money back and leave a neutral.
RE: case #1: Contact the seller, give him 24 hrs to respond - if he doesn't, file a SNAD complaint and report him for excessive s&h (if he handles the complaint badly, you really should hit his DSR for S&H charge). Only problem: your refund will again be via Paypal, no? For a fee of $1.50 Paypal will cut account holders a check, but whether they do that for non-account holders I don't know . Maybe just sign up 'til your refunds clear then close it?
