I had to REPOST it in it's UNEDITED entirety, to PROVE that it even ever existed.

I understand that the video it'self has nothing to do with you personally, but, given the current circumstances, regarding it's "SUPPOSED" DMCA, I think that it's relatively topical.

The two initial people involved should actually keep it between themselves and their friends and whoever else close to them. What I hate about the DMCA claims, YT automatically will give you a strike even if you file a counterclaim. When you prove you are innocent, then the strike gets removed. I can understand YT won't act like a lawyer and I think it's fine that they remove the vid which they did to tomken8dy and me. However, why the strike right away?
Well, the "fair use" is only a policy (guideline), not a law and not a right and only applying to the US Copyright Law. But our videos are uploaded for public broadcasting all over the world. We've to meet the requirements of ALL copyrights all over the world. So "fair use" is actually kind of non-existing on YouTube as your videos have to meet the international requirements of copyright and "fair use" is no part of it.
Still, it sucks what he did ... it's not right but it's his right.

Go to the DMCAabuse channel. Its primarily geared toward Creationist DMCA abuse, but there are good people there who'll help you out.

I'm genuinely curious. I have a woman who "CLAIMS" she has filed an Official DMCA claim against me, for my re-posting of her ENTIRE 5 minute video that she posted SPECIFICALLY about me, and then she DELETED a day later. I was very SMART so I downloaded a COPY of her video asap, just in case
I had to REPOST it in it's UNEDITED entirety, to PROVE that it even ever existed.
She was DENYING that it ever did.

The two initial people involved should actually keep it between themselves and their friends and whoever else close to them. I'm sorry this happened to you. I know I read that one could use a small portion of a vid for comparison or to make a point basically. This is the copyright law. What I hate about the DMCA claims, YT automatically will give you a strike even if you file a counterclaim. When you prove you are innocent, then the strike gets removed. I can understand YT won't act like a lawyer and I think it's fine that they remove the vid which they did to tomken8dy and me. However, why the strike right away?

Well, the "fair use" is only a policy (guideline), not a law and not a right and only applying to the US Copyright Law. But our videos are uploaded for public broadcasting all over the world. We've to meet the requirements of ALL copyrights all over the world. So "fair use" is actually kind of non-existing on YouTube as your videos have to meet the international requirements of copyright and "fair use" is no part of it.
Still, it sucks what he did ... it's not right but it's his right.
