  • U.S. citizens have a right to carry arms, not a liberty. A liberty applies to everyone. Everyone has the Liberty of Free Speech. Noone can take that away from you.

    The reason I say you have the right to carry arms is because a right can be taken away from you. Your right to vote can also be taken away from you if you are a felon, just as your right to carry can be revoked. Does this make sense.

  • In Minnesota it is a misdemeanor to carry a gun into a place that has a sign posted banning them, or if you are told you cannot carry by any employee.... Gas Stations are public places, and in MN I have yet to see a gas station that does not have a sign banning guns. Check your local laws, they vary but Starbucks can kick you out if they want to, at least in MN.

  • Blanchard Oklahoma authorities don't plan to file charges against an Oklahoma woman (18 year old Sarah Mckinley) who fatally shot a New Year's Eve intruder at her house while she had a 911 dispatcher on the phone, but the intruder's alleged accomplice has been charged in the death.

    Oklahoma law allows the use of deadly force against intruders, and prosecutors said McKinley clearly acted in self-defense. According to court documents, Martin was holding a knife when he died.

  • In New Orleans after Katrina, the police mainly went into "WHITE NEIGHBORHOODS" to confiscate guns. I've never seen any videos of the police in black neighborhoods getting guns. Has seen anyone seen such videos? I smell a rat here. There seems to be an anti-white bias behind gun control&confiscation. If New Orleans was a dry run of future gun confiscations, then wake up white America. Think about it FYI.

  • this is interesting because here in Florida, "Brandsmart" (a public all-in-1 type store) has a sign that bascially says no weapons are permitted on their property..concealed permit or not

  • @swordsman3000 Right now I think this is more of the Judge's opinion than anything else. Many states have laws that allow property owners (even those open to the public) to ban firearms. Also in most states you can be asked to leave a property for pretty much any reason and if you don't you could be charged with trespassing. Should it be this way? Maybe not...for now it is.

  • Keyes and most who promote gun rights miss the point. They frame the debate as the public against common criminals. "The Second Amendment was clearly intended to counterbalance a distrust of a potentially oppressive federal government". We have the right to bear arms to protect ourselves and families against OUR OWN GOVERNMENT and not a single politician will say it!

  • Self defense is a natural right. I am insulted that the Federal government has to step in and say I have a right to own/carry a handgun for self defense. You should be able to do it without someone telling you that you can.

  • VikingAndreas, it's not the object, that is the right. The right, is the right of self defense, the object, "arms" is the tool necessary to that right.

  • @traingp7 Ramel should. What if one of the cops at the dunkin donuts pulls out his or her gun because he feels "threatened". We should disarm the cops so it dosn't happen. Citizens shoot and kill at least twice as many criminals every year as do police (1,527 to 606) but police are more than 5 times more likely than a civilian to shoot an innocent person by mistake. BTW I'm being sarcastic about disarming cops. No sane person would seriously sugest disarming the police unless they hated cops.

  • I wouldn't want to risk a trespassing charge by walking armed past a conspicuously placed no guns sign on a door. You may be able to argue your way out of this in court but you're likely to need some help. I OC every day, and I support a business' right to select who can patronize their store.

  • @OaGuardian The key words are "more likely". How is that ridiculous? If you have a gun you are more likely to use it, then if you don't have a gun. You don't have to be a criminal to pull out a gun and use it or flash it. I've been in the military for over 10 years and I can tell you plenty of stories where my friends have pulled out their guns because they were scared or felt threatened. All it takes is one time for an incident to turn tragic.

  • I disagree with this judge. I use to live in Germany for 4 yrs. I don't know if the laws have changed, but when I lived there, there were no real guns allowed and people carried gas guns for defense. Death by gun was practically unheard of. Besides how does more guns equal less violence? When you have a gun you are more likely to want to use it.

  • @Ramel34 In every country that has banned guns the murder rate has actually gone up dramaticaly. In australia it doubled in only one year after the ban. The murder rate and violent crime rates in the states that allow concealed carry like texas and florda went down after carry was legalised. Banning guns is friggin stupid, it dosn't save lives. Guns save lives.

Not allowing citizens to carry as is their constitutional right makes about as much sense as disarming the police.

  • The judge is wrong here. Starbucks can disallow people who are carrying firearms from remaining in their stores.

  • @Stink808 Starbucks can ask you to do many things. They can ask you to leave your gun in the car, they can ask you to stand on your head or sing a silly song. It isn't an order but a request to be done at your own approval. They can however, ask you to leave if you are armed and if you refuse, request that you be cited for trespass.

    Even though there have been almost no problems with open carry, the time that ONE issue does occur, it will be used to smear credibility when statistically it makes no sense. Remember that Brady Bunch.

    say a woman is walking home from the store,shes unarmed,an attacker comes up and proceeds to rape her in the alley,what is she gonna do,slap him?

    she gets raped and possibly dead.

    same woman carries concealed,rapist ends up dead and/or wounded.woman is fine.

    same woman carried openly,rapist sees the firearm and not wanting to be shot,moves onto easy victims.

    statistics prove it.

    Notice he says they cannot tell you to leave your gun outside-he didn't say they couldn't tell you to leave the property. In VA, if you're asked to leave and don't, you can be charged with trespassing.

  • I'm a huge 2A / OC / CC supporter, but I have never heard the argument that Napolitano makes here. I was always under the impression that as a guest on private property, property owners can kick me out for whatever reason they want to. If I fail to comply, I am trespassing.

    Just like if I didn't like a business, I can't go on their property and warn customers how much they suck. While it may be free speech, I can be asked to leave and arrested if I refuse to.

  • There is a difference between a private business which has no public accommodations like an IBM or a Microsoft who can ban guns and kick people off their property, and one that opens its doors to the general public. A public business can no more legally ask a gun owner to leave than they can ask a person of color to leave their store. Self defense is a fundamental right and while a private business with no public access has a right to ban anyone they like (my belief), public access ones do not.
