a breathalyzer is not admissible in court, it is only used as a tool to verify the officers observations. he was taken to jail because of his actions (aggressive behavior, very talkative, unable to remain calm, constantly pacing...other things you may not see such as blood shot or glassy eyes, dilated pupils, "1000 mile stare"). A person could be under the influence of any kind of illegal narcotics or prescription drugs, that would still be a DUI.
