@Efrain891 Reasonable suspicion has to be proven in court and applies to cases closer to searching a guy in a trench coat looking at security cameras in a bank. Other cases where they don't need a warrant includes plain sight stuff (drugs in a house seen in a window from the street. In general though, a court must issue a warrant giving a detailed explanation of what the suspicion is and what is to be taken.
@dan1088352 Oh ,because I was walking down the street once and a cop car cut my path and 2 cops frisked me saying "I matched the description of a suspect" after they searched and found nothing they let me go, but I told them they couldn't frisk me like that, but like I said they said they had "reasonable suspicion".
@Efrain891 That probably counts if you actually did match the description. The rules of searching are more court rules, if the search was indeed illegal the evidence would be inadmissible in court. Should you have had something unrelated on you that they arrested you for you could argue that they had no cause in court, if they lied about the suspect thing the case would be thrown out. Unfortunately in your instance we'll never know if it was legit or if they were harassing you.

I have had my person and property searched under a false pretense of being at the wrong place at the wrong time because I was in the vicinity (appx 200 yards) of a warehouse that had been robbed one time in previous months. I was searched because New Yorks finest apparently can't tell the difference between a rolled cigarette and a joint even when it's burning. But they are doing good with this effort to inform people of their rights and I , for at least once in the years since I joined the ACLU, am glad I pay my dues each month. @Efrain891 Reasonable suspicion has to be proven in court and applies to cases closer to searching a guy in a trench coat looking at security cameras in a bank. Other cases where they don't need a warrant includes plain sight stuff (drugs in a house seen in a window from the street. In general though, a court must issue a warrant giving a detailed explanation of what the suspicion is and what is to be taken.

@dan1088352 Oh ,because I was walking down the street once and a cop car cut my path and 2 cops frisked me saying "I matched the description of a suspect" after they searched and found nothing they let me go, but I told them they couldn't frisk me like that, but like I said they said they had "reasonable suspicion".

@Efrain891 That probably counts if you actually did match the description. The rules of searching are more court rules, if the search was indeed illegal the evidence would be inadmissible in court. Should you have had something unrelated on you that they arrested you for you could argue that they had no cause in court, if they lied about the suspect thing the case would be thrown out. Unfortunately in your instance we'll never know if it was legit or if they were harassing you.

I have had my person and property searched under a false pretense of being at the wrong place at the wrong time because I was in the vicinity (appx 200 yards) of a warehouse that had been robbed one time in previous months. I was searched because New Yorks finest apparently can't tell the difference between a rolled cigarette and a joint even when it's burning. My friends and I had our persons and properties searched for hanging out at a popular secluded spot. ALL DONE ILLEGALLY! FUCK THE POPO!

I like what the ACLU and ACORN did in this instance. I pay membership dues to the ACLU though there are a lot of things I disagree with them on. But they are doing good with this effort to inform people of their rights and I , for at least once in the years since I joined the ACLU, am glad I pay my dues each month. I joined them back in 2001 ,right after the attacks on 9/11 and the Patriot Act came into existence.

Yes, the grammar could have been better, but I think some have missed the most important point. Our rights are being stripped away as demonstrated in the video.
They (the establishment) always harassed minorities, disenfranchised and the poor. The ironic part is and the police know it, the true firepower (guns, bombs etc) are in the white communities, not in the minority communities.
