I think the burden of proof is on you...if you are on railroad property other than at a designated crossing, you are tresspassing. Trains can't veer out of the way. People are not being forced to stand in front of the train while it hits them. Trains have the right of way at all times, and people who fail to yield are at fault. What evidence do you have that suggests otherwise?

However, BNSF was responsible for the 2002 incident and a man acted alone in derailing the trains involved in the 2005 incident. Not only were the people on the trains victims, but it was an attack on Metrolink as well.
Why should someone be able to sue Metrolink, operating within federal guidelines, when someone deliberately derailed the train?
Federal guidelines are a floor and not a ceiling. California negligence law still applies. If you want to learn more, I suggest you enroll in law school.

My heart goes out to not just to all the family members who lost a loved one, but to the firefighters, who will for years to come, will re-live in there minds and dreams over & over, all of those images of those who did not make it.
