  • Your dealing with copyright law when you film. In Canada the photographer can take pictures of anyone in any public place or public event without needing or asking their permission. If the cop was to pay you (Contract) for the photo or in this case video then he would own the image or video. That's the way it works here in Canada, Don't know where you are but if it's the same the cop has no right. He can ask but you don't have to do it.

  • The First Circuit Court of Appeals has declared it is not illegal to film a police officer, whether they know about it, or not. Know your rights. If they're doing their job right, it should only help THEM if you go to court. It helps you, and it helps them. It keeps everyone on their best behavior. In some states, police officers can lose their jobs for preventing you from filming them, or destroying tape evidence.

  • In general, if you can see it - you can photograph it. Public spaces are fair game for photography. In addition, you can photograph private property while you are standing on public property. If someone is in a public place you can photograph them. This includes private property used as a public place. Churches, malls, office lobbies, and other privately owned venues are still public spaces.

Such as if someone says they don't want their face showing in the video then you have to abide by that by putting a blur over their face. It's illegal to show their face or record it if they request otherwise.

    It is standard procedure for a cop. Respect is key when dealing with a cop he is doing his job and he is not a civilian so therefore he has the right to state (even if he didn't) that he doesn't want his face all over the web. This particular video fits just enough under the statute of limitations on ridicule as a cop is not a civilian he has the right to (if he decides) to come forth and argue that it was against his rights or such. as most these comments are ridicule.

  • @norvell84 No, a cop does not have any more rights than a civilian when it comes to filming. Nor is there any legal requirement to be respectful to police - you should be respectful to everyone, but again there is no legal requirement. Yes he does have the right to argue, just like a civilian does, but everyone has the right to film in public. No one, even cops, have the expectation of privacy in public. Courts have already ruled on this.

    I do not believe that photographers should be hassled or jailed for taking photos of police actions as long as their doing so does not jeopardize an on-going investigation. However, I believe there is a large segment of the public that whips out their cameras and purposely antagonizes police officers doing their jobs simply to see if they'll get hassled or harassed. The video whole purpose is obvious.

    HE motioned for him to stop recording, then he saw he didn't so he asked if he live there which he replied no. SO the cop asked him to stop recording cause it is illegal to record anything on someone's property without there permission. A cop main duty is to prevent chaos of any kind, sure no one from that property caught him, but they could have. It is hard to explain without just copying it out of a handbook. I agree with you, but ... you know? :)

The cop didn't use any threat of violence or anything - he simply asked him to stop, which every citizen has the right to do - and the cameraman has the right to say no.

  • if both you and the cop were on a public sidewalk or public easement (roads, access, freeway), then you can film him all you want, if the both of you were on private property then you cannot film him. you cannot record the audio if you were not a party to the conversation. if he starts talking to you, you can record the audio.

  • @ReportTheHackers What statute says that you can't film on private property? Also it depends on the State whether or not you can record audio without the other parties consent. Here in VA where I am, you only need one party consent. So if I'm the one recording, then I am giving myself consent. This even applies to recording telephone conversations.

And another reason is that would you like somebody to record you doing your job and posting it on youtube. If they charge people videoing them with under wire tapping laws then they also have to charge people under wire tapping laws for traffic light cams, Mall security cams, and any other kind of security and traffic cams.
