    It was to protect his own ass, research the kinds of legal and physical abuses are going on at these checkpoints.

    Better yet, research WHERE these checkpoints are located. They're NOT on the border, they're anywhere from 35 to 150 MILES inside both the north and south borders.

    By law they're only allowed ONE question, Citizenship, anything else IS ILLEGAL.

They probably joined without prior knowledge of the check points and are being forced to work there as part of their service. If you don't like the check points, then how come instead of bothering border officers you put more of your effort towards getting rid of the fucking checkpoints?

    License plate and Facial recognition technology have been used for years to INSTANTLY identify someone by linking the technology to databases containing driver's license info, insurance info, & personal info, fake ID's don't show up in the database.

    The ONLY reason for having a person question each car is to trip people up and get them to secondary where they can be searched & busted for the tiniest things

    And to answer your question, checkpoints like these are taking away people's right to free travel within their own country without being subjective to unlawful searches and seizures, like I said, CHECK THE 4TH AMENDMENT.

    As soon as you pull up to a checkpoint like this a background check is run by the plate number, they KNOW who you are without asking.

    1. This isn't a "pull over" by a cop who has to have Probable Cause for the stop in the first place, it's a checkpoint 40 to 50 miles AWAY from the border, and they're not "checking ID's", they're just asking Citizenship and letting people drive off after they get their answer. Ineffective to say the least.

    2. There's no need for DHS to do checkpoints when Border Patrol already exists, let them do their job without DHS interference.

They have existed for decades (pre 9/11/01) you can find them within a couple hundred miles of the US/Mexican border in every state that borders Mexico. 9 times out of 10 they just ask if you are a US citizen and you go. They provide a very necessary service to this country. To be honest he should have detained you for hours for being such a hard headed fool.

    You are incorrect about the 24 hour hold without probable cause. I think you are mistaking it for the hold allowed before you mist be formally charged. They still have to have probable charge for the original arrest.

If they could not afford to pursue this - and if there were a real case - there are plenty of lawyers who do things pro bono for many vaild reasons, or just take a portion of the penalties collected in a civil suit. The way that people who need to feel important do it is by acting like an asshole and uploading the videoon YouTube.

  • @peraspira: The problem with your solution is that usually one must first be arrested and charged; something these agents seem loath to do. In fact, once they went so far as to call in local law enforcement to do the job for them. The driver was found not guilty of all charges.

He's so confident about his rights but stops for an unlawful checkpoint to be defiant and arrogant. Arrogance and ignorance are truly exemplified here by the driver.   • People are constantly complaining about illegals...that what these are for. The officer is a border patrolman, he's doing his job. Checkpoints like this have been in place long before Sept.11, 2001. I've been through these checkpoints near El Paso dozens of times...Never detained. They just ask you it you are a citizen and look at the vehicles occupants. Now however, they do have a dog circle your vehicle to sniff around for drugs. No big deal. I am glad they are there.

  • I was at this very checkpoint during my trip to arizona and the following happened to me: as we were driving to the checkpoint we slowed down and one agent gave a hand signal which appeared to mean that we should proceed. As we sped up the agents came running so we stopped. He then asked where we were from and since we were not american citizens we were removed from the car and we spent 30 min in that booth thing.

  • Correct me if I am wrong but because of the difficulty of discerning whether an automobile is transporting illegal aliens, police may set up roadblocks near the boarder to stop ever car to check the citizenship of its occupants. (see. U.S. v. Marinze-Fuerte and U.S. v. Vallamonte-Marquez) ... Don't think this is unconstitutional unless this wasn't near the boarder, etc.

    However, The US constitution gives us the 5th Ammendment. The right to refuse to answer the law given that the answer may be used to prosecute you in court. Or your Miranda rights... the right to remain silent. There's also the 4th Ammendment that gives the right to be secure in your person (you, your car, your home, backpack, etc.) against unreasonable searches and seizures without a warrant or probable cause.

The border patrol agent should have pulled the driver into secondary inspection using irrational behavior suspicion of being under the influence. He's just doing his job like every other average joe. Act like a child, get treated like one. Answer the question, get on with your life. These checkpoints have recovered countless weapons, thousands of pounds of drugs, and thousands of illegal aliens.

  • the dep. of homeland security is only doing his job and that checkpoint makes since becuase it is in arizona A BORDER STATE TO MEXICO where drug smuggling occurs, now if this checkpoint were set-up in a state like kansas or somewhere in the midwest then yea i could see where it would be wrong and out of place
