The fact is I do not condone impaired driving of any kind, be it alcohol or cannabis. That person did not responsibly use marijuana, and it bit him in the ass. Okay I gotta say though, when you're smoking good stuff driving becomes extremely difficult. That's why there's DUID laws in place and even NORML, the most proactive organization I've seen to date has a code of conduct that explicitly instructs that driving withing the first 2 hours of a high is not advisable. It may not be the most dangerous thing in the world, but lets be smart and give the law enforcement no reason to hassle smokers.

As a law enforcement officer with narcotics experience I can say that this is definitely a false alert...the handler was clearly coaching the animal. We must be careful in our zealousness to do our job, or sometimes in our desire for some excitement or break in the monotony of police work, that we do not become the criminal that we have sworn to protect others from.

An alert includes K-9 behavior changes AND A SCRATCH. The pre-alert you speak of could be any odor of interest i.e. cat or dog odor. Merely showing interest is not enough to call an alert. If this were a true alert, the dog would have scratched when interested in the door the first time.

I have seen dogs pre-alert all around a car when there is a large amount of odor and they can't pinpoint it's origin. A pre-alert is all a good handler needs to read their dog. Body language on food and animal odors is COMPLETELY different behavior, since their reward is not connected to the action. The actual "scratch" is strictly for the court..not the dog handler.

This car only had one ounce. That is not a large amount. I guarantee I can hide food, tennis balls, your dog's toy and narcotics all in different spots, then allow your dog to search for them. During the dog's posture changes you call "pre-alerts", YOU WILL NOT BE ABLE TO DISTINGUISH if the dog is reacting to drugs or the other legal items. The scratch is for the handler. It's very sad you believe the other way because it is wrong!

This is clearly NOT a false alert. The dog is obviously in odor as he walks around the car the first time (he pulls back to the drivers side door). The second time around the car, the dog alerts from the outside of the car! I bet there was at least an ounce of meth in this car.

If so, this video is clearly disputable, the cop looked like he was hiding his hand, probably snapping his fingers everytime they passed the driver door, it was only on the 3rd time that there was an obvious reaction, after the obvious cohersion of the cop.

We beat this case in court. The driver walked after the judge suppressed the evidence based on it taking too long for the dog to arrive at the scene. The judge would not comment on the false alert argument.
