It's just like, for instance, both Stone Temple Pilots and Radiohead have a song named "Creep", and that song is one of each band's most well-known songs. You're allowed to name a song a name that another band is already using for one of their songs. It's not theft.

In this case a three word song title was chosen (making up a phrase that's not exactly in everyday usage) that is identical to a title used on an important song 25 years prior (Kiss also "stole" the phrase for a late 90's song title). Come on, what if a band titled an original song "stairway to heaven". Would you admit that was theft?
