  • It's a good idea to be polite to police but I don't really talk to them..... you should watch the video here on youtube called DON'T TALK TO POLICE.... you may already watched it but it's a good video. A lot of cops are assholes so you don't wanna risk saying something that may be used against you. I have had local police threaten me with revoking my conceal handgun license but no luck lol the cop was a short little man with a chip on his shoulder and I stood my ground.

    There are a few states that want to make it ILLEGAL to video and audio cops doing their job. That needs to be stopped. To stop that every one that use a video need to write and ask both state and fed to write law that will allow the recording of cops. Next every time you see one of these so called people representatives ask then in front of a crowd why there is not a law that allows people to video them.

  • @samten10a In New Hampshire this term (2011), we're likely to revamp the wiretapping laws to a one party consent system. It failed last year because they just tried to amend the current poorly written one. This year, they are going to delete and restart.

  • @ixVENGEFULxi A previous time that I knew they were looking from me, I evaded them (sat down on a bench for 20 minutes near a river). A lawyer I know told me I should not do that.as they could use that as a reason to detain me... so when I think they may be looking for me, I do my best to ensure they can find me. Generally though I walk a circle around the town and never return to somewhere that I had previously walked.

  • If you conceal carry here in CA without a ccw permit (which are very difficult to obtain) you'll be facing some serious charges and jail time at the minimum.

    If you choose to carry no weapon at all then you're just subject to whatever the wolves of society desire of and/or from you which very likely can be your life. I've been attacked before in broad daylight, it sucks.

    Or choose to open carry and suffer the police harassment and funny looks... its a very small price to pay for safety.

  • @caneywaney the right to bear arms (carry) is a right. I open carry because to conceal is to beg permission. Concealing is a privilege. I have to get a permit that may be revoked. Or I could just do it openly.

    Open Carry is crime deterrence. Cops get free coffee to encourage them to come back. Police are around alot means less chance of getting robbed. Open carriers are often confused for police. Make sense? A gun is a right. Most states OC is a right. welcome to america, we got guns

  • The officer did not give me permission or rescinded permission. It's never been to court and that conversation wasn't worth taking it to court so I transcripted the officers side.

  • You do not need anyone's permission to video record them in public. In public you have no expectation of privacy law enforcement or otherwise. As a matter of fact normally the police are recording you through their dash cam and never ask for your permission, plus these tapes are available to ANYONE through freedom of information act.

  • New Hampshire has a strange wiretapping law which requires verbal consent even in public. This guy is an activist I think he knows the laws =D

  • @UOGSammich the laws might work a bit better in NH for OC than here in Pa but our wiretapping laws work better for us. As a public official performing a public service police have no expectation of privacy while on duty.

    I believe in some state you cant even listen to scanners as that is electronic interception

  • One more thing. Why not travel in pairs of two or three? Stop me if i'm wrong on this. But if you are stopped by the police and they say they do not want to be recorded. You can hand the Camcorder off to the other person and give them the ok to record you. As long as someone gives the ok to record it's legal is it not? thats what they did on the Farm with the ASPCA. The cop said no and arrested him and the lady took over and recorded it. It was ok because the person said yes. Is that not legal?

  • The other person would still have issues recording the voice of the officer. Same issue I would have. The 'fuzzy' up of the camera while I'm talking is because the camera is being held under my arms and I'm turning it on when I'm talking and off the officer is talking. I missed the first part because I wasn't paying attention to the camera after I was told to not record him.

  • You cannot film someone (even an on-duty officer) where that person has reasonable expectation of privacy without risk of being charged with wiretapping (audio recording without consent). Unless the cop is in a restroom or locker room, there's almost nowhere an on-duty cop is at that falls in that category, especially when the cop is performing a Terry stop.

    Basically, where they can film you without your consent, you can film them without their consent.

  • A good approach when told by police to stop recording is to ask them, "May I ask a question: Are we in a place with reasonable expectation of privacy". If they say "No", tell them, "Then I have the right to record, and I respectfully decline to stop recording." If they say "Yes", then you could ask them, "So then if I stripped naked right now, you wouldn't arrest me for indecent exposure?".

    It's always a good idea to answer questions respectfully with questions whenever possible.

  • I agree. Where there is no reasonable expectation of privacy, then no invasion of privacy is possible. But people still get arrested for "wiretapping" and other bogus crimes when they record police.

    It depends what state you are living in how outraged the citizens were over J Edgar Hoover wire tapping. Some require all parties to conversation agree to the audio tapping others only one person need to agree to it . it should be changed so you can audio & video tape a cop in public as long as you are not causing a problem

  • What are the laws on this? I have been unable to find any thing. When your open carrying and the officer stops you. Asks for your name and adderss. Do you have to give it to them? Can you put a law or a link to the law on it? I have seen them say well we need that information to make sure your able to have guns. You don't give it your going to jail on this that and half a Mill other things.

  • In New Hampshire if I'm stopped for only open carrying, I do not have to give the officer ANY information. The last two detentions I actually refused to provide my name/addr. They knew me and looked up my name after I left in dispatch.

  • This is incorrect. Since 2004, SCOTUS reviewed Hiibel v. Sixth Judicial District Court of Nevada and determined that you must provide officers conducting a Terry stop with your name and address when requested, as your "right to remain silent" is specifically the 5th Amendment, and your name and address is not information that can incriminate you.

    However, you can still ask police, "do I have the right to not provide that information and remain silent", and most will probably say "yes, you do".

  • In the 2000 case, J.L v Florida, SCOTUS ruled that possession of a handgun was not enough to justify a Terry Stop. Therefore, this is not a Terry Stop, it is a consensual encounter. For a consensual encounter, it's not required to provide any information to the police and they cannot stop you from walking away.

  • J.L. v Florida ruled that an anonymous tip alone was not sufficient to justify a Terry, but was sufficient to make identification so that police could observe in order to justify a Terry stop. In that case, an individual was carrying unlawfully, and police acted solely based on the tip, not based on observation which SCOTUS said would have corroborated the tip.

    Almost all open carry incidents involve the police receiving a tip and then observing the suspect. Then they make the confrontation.

  • Thanks digginforgold, that was a much better description of JL v Florida than I had offered. I will maintain, however, that since OC is legal in NH, open carry of a firearm does not warrant RAS for a Terry Stop in this incident. That's why I say this must have been consensual. If this were a Terry Stop, the gentleman could argue that this was an illegal seizure.
