Firefighting is both dangerous and done by people to help others, and when she screws over the best qualified candidates, she's screwing over not just heroes, but also future victims of fires who may have been saved or spared horrific burns by better firefighting.
She refused to intervene and change the decision of local authorities with regard to the firefighter ruling. I challenge anyone to prove that there has been an increase in bad outcomes to the community because of that ruling.

Another issue regarding affirmative action is what is done when minorities are overrepresented. Based on what I'm learning about Sotomayor, had the firefighters passing the test been overwhelmingly minorities, I doubt she would've ruled the same way in order to give the whites a second chance to qualify. If we are going to embrace it, shouldn't affirmative action cut both ways?

Justices typically serve for many years, so they roughly represent not current day nominees, but those qualified about 15 years ago. Fewer women deciding to enter law school around 1950-60 means fewer female judges and justices today.

I do believe in fair chances, but fair to me means someone who has worked harder or saved more to go to college shouldn't be denied because of their skin color (even if white).
In a surreal world that would be nice, but not in the real world in which we live in today. Where Harvard did not allow even one qualified black kid even to use their bathroom. Where even after the bill of rights, there are colleges imposing out of ordinary tests and increasing their tuitions, so that those poor (blacks, whites and hispanics alike) at the bottom can't even dream of becoming doctors, lawyers or anything else.
That kid that fail to get into Harvard school because of affirmative action can get into Yale, Princeton, and hundreds of other well opened Universities where white compromise 70 to 80 percent of attendees.
Where tests where purposely developed to make it more difficult for Blacks, Hispanics and alike. It would be even be easier today with all the accessible data on the internet about the intellectual shortcoming minorities.
Afirmative action is not intended to hurt people, it is intended to help people. However, there are some people who want to make it look like a discriminatory action to get rid of it and get back to how it was before.
The poor have a voice when they stay in school, learn to read, write, and speak fluent English, avoid making babies at an early age, take care of the kids they bring into the world, and show respect to themselves and others. It's that simple.

Of course, the other things aren't equal, since the pool of qualified candidates is more than 37% white male (due to historic and cultural reasons). But is that pool as high as 78% white male?
And 96% of all SCJs in history have been white male.
I think that whenever the 1st Hispanic SCJ is chosen, he/she will be accused of being just a token no matter how brilliant they are, so might as well break that barrier now so future Hispanics won't have to go through that (as much).
This is assuming that a Hispanic is found that is of at least comparable qualifications of the white male candidates that will be used as the media's measuring stick. (Of course, if the Hispanic is clearly superior, then it's a no-brainer.)
Who cares if THE CHOSEN ONE has picked her and there are 60 Dems in the Senate. If a DA can indict a ham sandwich, any warm body Barry chooses will be confirmed.
If you care about the best for the job, the occasional white male might be in the mix, but there is clearly not the case.

The law applies regardless of race and anyone who thinks empathy should come into play is simply dead wrong. The job of a judge is to apply the law as it is written and race, sex, etc. DON'T come into play. Sotomayor strikes me as someone who, like The President, thinks emotion should be part of being a judge.

@nic190 La Raza is a Mexican Organization. Not Puerto Rican. Do not mix up the groups. She is indeed a member of the NCLR which is a Hispanic Civil Rights Organization. There is nothing extreme there. Additionally, she is first and foremost a New Yorker who has a Puerto Rican background. HotFile, Obama never said he elected Sotomayor as nominee "because she is a woman and hispanic". He mentioned her oustanding qualifications and extensive work experience. Sotomayor made a couple of comments she probably regrets now. Every public figure makes silly comments at some point. These are now blown out of proportion and taken out of context. Courts of appeal (all the way up the Supreme Court) inevitably make policy one way or another because they can *establish* legal precedents. Every precedent that's followed now was once brand new -- and established by some court at some point.
Whether the Supreme Court had chosen to hear Roe v. Wade or chosen not to, and whatever their ultimate decision, that decision would have no less *set policy* regarding abortion.
A court of appeal's power to rule gives it the power to make policy.

Firefighting is both dangerous and done by people to help others, and when she screws over the best qualified candidates, she's screwing over not just heroes, but also future victims of fires who may have been saved or spared horrific burns by better firefighting.

What concerns me is that no one is looking at her position on the Constitution and her personal beliefs. No judge is impartial - without exception thier world view is influenced by thier beliefs (and i am not reffering simply to religious persuasion).

Your mistake is the same as many who voted for Obama: you base your decision on words not action. She is highly intelligent, okay, but so was Hitler. So am I. What has she done? What's her record? Another issue regarding affirmative action is what is done when minorities are overrepresented. Based on what I'm learning about Sotomayor, had the firefighters passing the test been overwhelmingly minorities, I doubt she would've ruled the same way in order to give the whites a second chance to qualify. If we are going to embrace it, shouldn't affirmative action cut both ways?

The speech is not "cerebral", and was hosted by an overtly racist network of organizations. Why would this change anyone's mind?

I don't care what the SCOTUS looks like. It doesn't matter. Steely, down-the-line interpreters of the law as it is written is what the country needs. We elect those who write the laws and those who interpret it are nominated and (sometimes) voted upon by those whom we have elected. It ain't perfect, but it's the best the world has to offer. Ms. Sotomayor has given the impression that it's OK to legislate from the bench. If that's not the way she feels, then she should say so.

I don't really care about her race or gender. What I believe and object to is that Obama only seriously considered candidates that weren't white men. If she were truly qualified, she'd have refused the nomination on the grounds that she doesn't believe it is fair for her race or gender should be considered. We're all supposed to be equal, not hired in equal ratios according to a formula based on racist discrimination.

I disagree that Obama wants to end affirmative action and other forms of institutionalized government discrimination against white men. He effectively said that he wishes someday white men will be so downtrodden that affirmative action will have nothing left to take from them. To Obama "racial equality" means not equal treatment, but equal results. If one group works harder or smarter on average, the fruits of their labor must be stolen from them and distributed to other less productive groups.

I remember back when I first saw the fairness discussion in an economics book.
Obama couldn't be more of a campaigner for equal results. He thinks if the results aren't fair then change the rules.
Maybe instead of changing the rules, people should go to college and get better jobs.
I think that is a better solution. Everyone would be better off and we wouldn't have to redistribute the wealth that hard working Americans have earned.
During the recession go back to school.

My concern is that you're looking @ Sotomayor's nomination as if it's in a vaccuum. Consider this: the Supreme Court interprets complex elements of law which affect an entire nation of citizens. At present it is 90% male and 8 of 9 Justices are white. Why is that fair? Are only white males "qualified" to interpret the law? No... Why shouldn't the SCOTUS look more like America?

How many "should" be white? 1 of 9 being black is 11%, 2 of 9 would be 22%, so 1 of 9 is the "correct" representation of blacks. Personally I don't believe in institutionalized racism.
Justices typically serve for many years, so they roughly represent not current day nominees, but those qualified about 15 years ago. Fewer women deciding to enter law school around 1950-60 means fewer female judges and justices today.

Pharaoh, you were the one arguing that the SCOTUS should have a certain racial and gender makeup to be "fair", not me. I just pointed out that the court already has a proportionate number of blacks and asked you what you would consider fair since you're obviously not satisfied now.
Don't accuse me of racism when you're the one who would like to single out white men for replacement based only on their race and gender.
SCOTUS has a large cultural time lag as the Justices are typically so old.

Where tests where purposely developed to make it more difficult for Blacks, Hispanics and alike. It would be even be easier today with all the accessible data on the internet about the intellectual shortcoming minorities.

Second, you assume that AA 1) Only benefits racial/ethnic minorities (legacies, economic factors, even "merit" scholarships = advantage for some), and 2) Only helps those who are not qualified (WTF? Yeah, if you make a look like discrimination, it will be discrimination. It is not discrimination. It is about allowing smart minority people get a chance at the richness that America has to offers. Black were not allow to read, write or learn about anything for hundreds of years. Hispanics did not grow here, don't speak the predominantly english language, live mainly in poverty neighborhood, are incarcerate the most. It is about giving then a fair chance. Did you know that there are more whites in poverty in the US than any other group? In the US the number of whites in poverty far exceeds the total number of Asians of all incomes levels. You say its about giving them a fair chance, but fair should apply to everyone. Policies designed to spread misery equally based on racial discrimination are not fair. Feeding minority children but letting white children go to bed hungry because somewhere some other white child is well fed makes no sense.

But, you can't say that by hiring a female hispanic with the same qualifications of those 8 males (7 whites) on the supreme court is discrimination and that affirmative action is not need it. Because, we all know that without the affirmative action, there would never be a female on that list or a black male or hispanic. They all will be white males with political connections to those white males in the senate or the presidency.

If you tell me that affirmative action requires every college to have 98 percent of the students be hispanics and 2 percent be the rest. Then, it is discrimination. Affirmative action is just asking every college of this great nation to have representation of the population. Moreover, it is not asking them to accept unprepared and uneducated people, which what many are trying to say and it is not true. All students that got there are well qualified and deserve it.

For any person who benefits from affirmative action, there is another person who has been racially discriminated against to make room for them, so no amount of it is good to me.
I do believe in fair chances, but fair to me means someone who has worked harder or saved more to go to college shouldn't be denied because of their skin color (even if white).

In a surreal world that would be nice, but not in the real world in which we live in today. Where Harvard did not allow even one qualified black kid even to use their bathroom. Where even after the bill of rights, there are colleges imposing out of ordinary tests and increasing their tuitions, so that those poor (blacks, whites and hispanics alike) at the bottom can't even dream of becoming doctors, lawyers or anything else.

I think b/c she is qualified and she is a woman, she should get picked. There has only been 2 women-ever-in the supreme court. It needs to be diviated correctly. I think by making it more equal, whether it be through gender or liberal vs. conservative means, it would make the supreme court's future decisions more unbiased-and that's the most important thing.

By "one third of our government is mostly white males", he means that one of the 3 branches of the government is 78% white males. According to your stats, it should be 37%, all other things being equal. Of course, the other things aren't equal, since the pool of qualified candidates is more than 37% white male (due to historic and cultural reasons). But is that pool as high as 78% white male?
And 96% of all SCJs in history have been white male.

I think that whenever the 1st Hispanic SCJ is chosen, he/she will be accused of being just a token no matter how brilliant they are, so might as well break that barrier now so future Hispanics won't have to go through that (as much).
This is assuming that a Hispanic is found that is of at least comparable qualifications of the white male candidates that will be used as the media's measuring stick. (Of course, if the Hispanic is clearly superior, then it's a no-brainer.)
