The right to free speech is a limited protection against persecution BY THE GOVERNMENT for speech that does not impinge on other rights. Nobody is getting censored here. They are being criticized for the content of their speech. They are being encouraged to raise the level of civility in their speech. They are not getting imprisoned or otherwise persecuted/prosecuted for their speech.

Segregation ended about 50 years ago the age of most of these white males talking about this issue.
The judge in question grew up during this time so she had to deal with racisim and segregation. So her comments are dealing with her life experience and the desire to make things equal.
